CIRCULAR
PROVIDING DETAILED REGULATIONS ON THE LIST OF GOODS FOR PURCHASE, SALE AND EXCHANGE BY BORDER RESIDENTS
Pursuant to the Government's Decree No. 98/2017/ND-CP dated August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government's Decree No. 14/2018/ND-CP dated January 23, 2018, detailing border trade activities;
At the proposal of the Director of the Import-Export Department,
The Minister of Industry and Trade promulgates the Circular providing detailed regulations on the List of goods for purchase, sale and exchange by border residents.
Article 1. Scope of regulation
This Circular provides detailed regulations on the List of goods for cross-border purchase, sale and exchange by border residents as prescribed in Clause 2, Article 12 of the Government's Decree No. 14/2018/ND-CP dated January 23, 2018, detailing border trade activities.
Article 2. Subjects of application
1. Border residents purchasing, selling and exchanging goods across the border as prescribed in Clause 3, Article 3 of Decree No. 14/2018/ND-CP.
2. Agencies and organizations managing and administering border trade activities.
3. Other agencies, organizations and individuals related to border trade activities.
Article 3. List of goods imported in the form of purchase, sale and exchange across the border by border residents
1. To promulgate the List of goods permitted to be imported in the form of purchase, sale and exchange by border residents as set out in Appendix I attached to this Circular.
2. Goods items outside the List prescribed in Clause 1 of this Article shall not be imported in the form of purchase, sale and exchange by border residents.
3. Where necessary to ensure food safety or to prevent cross-border epidemics, the Ministry of Industry and Trade, after consulting with the relevant Ministries and sectors, shall decide to temporarily suspend the import of certain goods items in the List of goods for purchase, sale and exchange by border residents promulgated under Clause 1 of this Article, in specific localities and for specific periods of time.
Article 4: Organization of implementation
1. The Ministry of Industry and Trade shall be responsible for:
Guiding and inspecting relevant agencies, organizations and individuals in implementing the provisions of this Circular.
2. People's Committees of border provinces shall be responsible for:
a) Directing the Departments of Industry and Trade to assume the prime responsibility for, and coordinate with relevant agencies in, organizing the implementation of this Circular together with relevant agencies of the province, and developing coordination mechanisms for managing the purchase, sale and exchange of goods by border residents in the locality.
b) Assigning the Departments of Industry and Trade to assume the prime responsibility for, and coordinate with relevant agencies of the province in, implementing the reporting regime to the Import-Export Department (Ministry of Industry and Trade) periodically before the 10th of every month and upon irregular request. The statistical report forms accompanying the periodic report on the situation of purchase, sale and exchange of goods by border residents are provided in Appendix II attached to this Circular.
Article 5. Effect
1. This Circular takes effect from the date of signing.
2. To annul Circular No. 54/2015/TT-BCT dated December 30, 2015 of the Ministry of Industry and Trade prescribing the List of goods for purchase, sale and exchange by border residents under the Prime Minister's Decision No. 52/2015/QD-TTg dated October 20, 2015, on the management of border trade activities with countries sharing a common border.
3. In the course of implementation, if difficulties, obstacles or arising issues occur, relevant agencies, organizations and individuals shall report in writing to the Ministry of Industry and Trade (Import-Export Department) for settlement.
