CIRCULAR

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 38/2018/TT-NHNN DATED DECEMBER 25, 2018 OF THE GOVERNOR OF THE STATE BANK OF VIETNAM PROVIDING FOR THE IMPORT OF GOODS SERVING THE PRINTING AND MINTING ACTIVITIES OF THE STATE BANK OF VIETNAM

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to the Government's Decree No. 69/2018/ND-CP dated May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to the Government's Decree No. 134/2016/ND-CP dated September 1, 2016, detailing a number of articles of, and measures to implement, the Law on Export and Import Duties; and Decree No. 18/2021/ND-CP dated March 11, 2021, of the Government amending and supplementing a number of articles of Decree No. 134/2016/ND-CP dated September 1, 2016, of the Government detailing a number of articles of, and measures to implement, the Law on Export and Import Duties;

Pursuant to the Government's Decree No. 102/2022/ND-CP dated December 12, 2022, defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam;

At the proposal of the Director of the Currency Issuance and Vault Department;

The Governor of the State Bank of Vietnam promulgates the Circular amending and supplementing a number of articles of Circular No. 38/2018/TT-NHNN dated December 25, 2018, of the Governor of the State Bank of Vietnam providing for the import of goods serving the printing and minting activities of the State Bank of Vietnam (hereinafter referred to as Circular No. 38/2018/TT-NHNN).

Article 1. Amending and supplementing a number of articles of Circular No. 38/2018/TT-NHNN

To amend and supplement Article 4 as follows:

“Article 4. Import of goods

1. On the basis of the written designation and authorization permitting the printing and minting establishment to import goods serving the printing and minting activities as prescribed in Clause 2, Article 3 of this Circular, the printing and minting establishment shall import goods serving the printing and minting activities prescribed in the Appendix - List of goods designated for import by the printing and minting establishment serving the printing and minting activities of the State Bank of Vietnam, issued together with this Circular, as follows:

a) For goods under items numbered 1, 2, 3 and 5: The printing and minting establishment shall base itself on the printing and minting contract between the printing and minting establishment and the State Bank to carry out the import of goods;

b) For goods under items numbered 4, 6 and 7: The printing and minting establishment shall base itself on the competent authority's written approval of investment policy or investment decision as prescribed in Article 4 of Circular No. 07/2020/TT-NHNN dated June 30, 2020, of the Governor of the State Bank of Vietnam providing for the investment in and procurement of goods serving the printing and minting activities of the State Bank of Vietnam, to carry out the import of goods.

2. The Governor of the State Bank authorizes the Director of the Currency Issuance and Vault Department to issue a written confirmation of the printing and minting establishment's import of goods serving the State Bank's printing and minting activities under the goods sale and purchase contract or other forms of written agreement between the printing and minting establishment and the goods supplier.

3. When carrying out import procedures, the printing and minting establishment shall send the Customs Authority 01 original of the State Bank's written confirmation together with the customs dossier as prescribed by law.”

Article 2. To replace the Appendix issued together with Circular No. 38/2018/TT-NHNN with the Appendix - List of goods designated for import by the printing and minting establishment serving the printing and minting activities of the State Bank of Vietnam, issued together with this Circular.

Article 3. Responsibility for implementation

The Chief of Office; the Director of the Currency Issuance and Vault Department; heads of units under the State Bank, and the printing and minting establishment shall be responsible for organizing the implementation of this Circular.

Article 4. Implementation provisions

1. This Circular takes effect on August 14, 2023.

2. To replace the phrase “Code under the import tariff schedule” with “Code under the Vietnam List of Exported and Imported Goods (hereinafter referred to as the HS Code)” as prescribed in the List of machinery, equipment, materials, supplies, components, parts and accessories imported for use in the printing and minting activities of the State Bank of Vietnam, issued together with Circular No. 01/2017/TT-NHNN dated February 7, 2017, of the Governor of the State Bank of Vietnam promulgating the List of machinery, equipment, materials, supplies, components, parts and accessories imported for use in the printing and minting activities of the State Bank of Vietnam./.
