CIRCULAR

PROVIDING THE LIST, SPECIFICATIONS, AND TECHNICAL CRITERIA OF MINERALS USED AS CONSTRUCTION MATERIALS PERMITTED FOR EXPORT

Pursuant to Decree No. 21/2026/NĐ-CP dated January 16, 2026 of the Government amending and supplementing a number of articles of Decree No. 193/2025/NĐ-CP dated July 2, 2025 of the Government detailing a number of articles and measures for implementation of the Law on Geology and Minerals and detailing the Law amending and supplementing a number of articles of the Law on Geology and Minerals;

Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government defining the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director General of the Department of Science, Technology, Environment and Construction Materials;

The Minister of Construction promulgates the Circular providing the list, specifications, and technical criteria of minerals used as construction materials permitted for export.

Article 1. Scope of regulation and subjects of application

1. Scope of regulation

This Circular provides the list, specifications, and technical criteria of Group II and Group III minerals used as construction materials permitted for export as prescribed in Clause 38, Article 1 of Decree No. 21/2026/NĐ-CP dated January 16, 2026 of the Government amending and supplementing a number of articles of Decree No. 193/2025/NĐ-CP dated July 2, 2025 detailing a number of articles and measures for implementation of the Law on Geology and Minerals and detailing the Law amending and supplementing a number of articles of the Law on Geology and Minerals.

2. Subjects of application

This Circular applies to state management agencies and domestic and foreign organizations and individuals engaged in activities related to the export of minerals used as construction materials in Vietnam.

Article 2. List, specifications, technical criteria, origin, and dossiers for minerals used as construction materials for export

1. The list, specifications, and technical criteria of the types of minerals used as construction materials permitted for export are provided in Appendix I issued together with this Circular.

2. Minerals used as construction materials for export must have a lawful origin, including minerals mined, recovered, traded, or transported within the territory of Vietnam on the basis of a Mineral Mining License or a certificate of registration for mineral recovery issued by a competent state agency in accordance with the law on geology and minerals.

3. Dossiers for the export of minerals used as construction materials shall be carried out in accordance with the law on customs and the law on foreign trade management.

Article 3. Responsibility for implementation and organization of enforcement

1. Relevant ministries, sectors, and localities shall coordinate with the Ministry of Construction to organize periodic or unscheduled inspections of compliance with the law in export activities of minerals used as construction materials in localities.

2. The customs authority shall take the lead in inspecting exported goods that are minerals used as construction materials in accordance with the law on customs; shall coordinate with the Ministry of Construction, the Ministry of Agriculture and Environment, and provincial-level People's Committees where it is necessary to clearly determine the list, specifications, technical criteria, and origin of minerals used as construction materials for export; and shall coordinate in providing information and data on the export of minerals used as construction materials through border checkpoints to the Ministry of Construction and provincial-level People's Committees upon request.

3. Provincial-level People's Committees shall coordinate with the Ministry of Construction in performing the function of state management and directing relevant agencies to conduct periodic or unscheduled inspections of export activities of minerals used as construction materials within their localities. On an annual periodic basis (or on an unscheduled basis upon request of a competent authority), they shall report on the situation of mineral exports using Form No. 01 issued together with this Circular before January 30 each year, for the Ministry of Construction to consolidate and report to the Prime Minister.

4. Exporting enterprises shall be responsible before the law for minerals used as construction materials for export, ensuring lawful origin and compliance with the list, specifications, and technical criteria for minerals used as construction materials for export prescribed in this Circular; and shall retain and provide, upon request of a competent authority, dossiers proving the lawful origin and the specifications and technical criteria of the exported minerals (including: the lawful Mineral Mining License; the mineral purchase-sale contract; invoices; the technical criteria analysis report issued by a testing organization; the export contract; and other related documents); and shall prepare annual periodic reports (or unscheduled reports upon request of a competent authority) to be sent to the provincial-level People's Committee (where the enterprise carries out export activities) using Form No. 02 issued together with this Circular before January 15 each year.

Article 4. Transitional provisions

Dossiers for the export of minerals used as construction materials for which the customs declaration was registered before the effective date of this Circular shall continue to be processed in accordance with the regulations in force at the time of registration of the declaration; where a new customs declaration is registered after the effective date of this Circular, this Circular shall apply.

Article 5. Effect

1. This Circular takes effect from June 1, 2026.

2. Circular No. 04/2021/TT-BXD dated June 30, 2021 of the Minister of Construction guiding the export of minerals used as construction materials ceases to be effective from the effective date of this Circular./.
