DECISION
ISSUING THE LIST OF SCRAP MATERIALS PERMITTED TO BE IMPORTED FROM ABROAD AS PRODUCTION MATERIALS
Pursuant to the Law on Government Organization dated June 19, 2015; the Law Amending and Supplementing a Number of Articles of the Law on Government Organization and the Law on Organization of Local Government dated November 22, 2019;
Pursuant to the Law on Environmental Protection dated November 17, 2020;
Pursuant to Decree No. 08/2022/NĐ-CP dated January 10, 2022 of the Government detailing a number of articles of the Law on Environmental Protection;
At the proposal of the Minister of Natural Resources and Environment;
The Prime Minister issues the Decision on the List of scrap materials permitted to be imported from abroad as production materials.
Article 1. To promulgate together with this Decision the List of scrap materials permitted to be imported from abroad as production materials.
Article 2. Organizations and individuals directly importing scrap materials as production materials may only import scrap materials as production materials for their own facilities in accordance with the designed capacity for manufacturing products and goods.
Article 3. Transitional provisions
1. Paper scrap with HS code 4707 90 00 permitted to be imported from abroad under a component environmental license (Certificate of eligibility for environmental protection in the import of scrap materials as production materials) already granted by a competent authority before the effective date of this Decision may continue to be imported until the component environmental license expires.
2. Plastic scrap and off-cuts with HS code 3915 90 00 permitted to be imported from abroad under a component environmental license or an environmental license already granted by a competent authority before the effective date of this Decision may continue to be imported until the component environmental license or environmental license expires, under the corresponding HS codes specified in Section 2.3 or Section 2.5 of the List of scrap materials permitted to be imported from abroad as production materials issued together with this Decision.
3. Types of scrap materials permitted to be imported from abroad under a component environmental license or an environmental license already granted by a competent authority before the effective date of this Decision, which have a different name (but with the same HS code) compared to this Decision, may continue to be imported until the environmental license or component environmental license expires.
Article 4. Implementation provisions
1. This Decision takes effect from June 1, 2023 and replaces Decision No. 28/2020/QĐ-TTg dated September 24, 2020 of the Prime Minister issuing the List of scrap materials permitted to be imported from abroad as production materials.
2. From the effective date of this Decision, the import of granulated slag (sand slag) from the iron or steel industry (HS code 2618 00 00) as a material for cement production shall comply with the law on products and goods regarding construction materials.
3. Ministers, heads of ministerial-level agencies, heads of Government-attached agencies, chairpersons of People's Committees of provinces and centrally run cities, and related organizations and individuals shall be responsible for implementing this Decision.
