CIRCULAR
PRESCRIBING THE LIST OF PRODUCTS AND GOODS OF MEDIUM RISK LEVEL AND HIGH RISK LEVEL UNDER THE STATE MANAGEMENT RESPONSIBILITY OF THE MINISTRY OF HOME AFFAIRS
Pursuant to the Law on Occupational Safety and Health No. 84/2015/QH13;
Pursuant to the Law on Product and Goods Quality No. 05/2007/QH12, as amended and supplemented by Law No. 78/2025/QH15;
Pursuant to the Law on Standards and Technical Regulations No. 68/2006/QH11, as amended and supplemented by Law No. 35/2018/QH14 and Law No. 70/2025/QH15;
Pursuant to Decree No. 37/2026/NĐ-CP of the Government detailing the implementation of a number of articles of, and measures to organize and guide the implementation of, the Law on Product and Goods Quality;
Pursuant to Decree No. 22/2026/NĐ-CP of the Government detailing the implementation of a number of articles of, and measures to organize and guide the implementation of, the Law on Standards and Technical Regulations;
Pursuant to Decree No. 276/2026/NĐ-CP of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Home Affairs;
At the proposal of the Director of the Department of Employment;
The Minister of Home Affairs promulgates the Circular prescribing the List of products and goods of medium risk level and high risk level under the state management responsibility of the Ministry of Home Affairs.
Article 1. Scope of regulation
This Circular prescribes the List of products and goods of medium risk level and high risk level under the state management responsibility of the Ministry of Home Affairs, together with their commodity codes (HS) and the corresponding quality management requirements.
Article 2. Subjects of application
This Circular applies to:
1. Domestic and foreign organizations and individuals operating in the territory of Vietnam that produce, import, export, trade in or use products and goods under the state management responsibility of the Ministry of Home Affairs.
2. Organizations and individuals involved in conformity assessment activities for the quality of products and goods under the state management responsibility of the Ministry of Home Affairs.
3. State management agencies in charge of the quality of products and goods under the management responsibility of the Ministry of Home Affairs, and other related organizations and individuals.
Article 3. List of products and goods of medium risk level and high risk level under the state management responsibility of the Ministry of Home Affairs
1. Issued together with this Circular is the List of products and goods of medium risk level and high risk level under the state management responsibility of the Ministry of Home Affairs and the HS codes of such products and goods.
2. The list of products and goods of high risk level and the corresponding quality management requirements for products and goods of high risk level are prescribed in Section I of the List of products and goods of medium risk level and high risk level issued together with this Circular.
3. The list of products and goods of medium risk level and the corresponding quality management requirements for products and goods of medium risk level are prescribed in Section II of the List of products and goods of medium risk level and high risk level issued together with this Circular.
Article 4. Principles for managing products and goods of medium risk level and high risk level
1. The quality management of products and goods on the List of products and goods of medium risk level and high risk level shall comply with the law on product and goods quality, standards and technical regulations; the regulations on conformity certification, declaration of conformity and quality inspection of products and goods, and the corresponding national technical regulations.
2. Where a product or goods on the List issued together with this Circular is concurrently subject to two or more corresponding national technical regulations, the organization or individual shall comply with all such national technical regulations.
Article 5. State management responsibility for product and goods quality
1. The Department of Employment is the product and goods quality inspection agency at central level, performing the state management function over the quality of products and goods of the Ministry of Home Affairs.
2. Product and goods quality inspection agencies at local level are People's Committees at all levels and specialized agencies of provincial and municipal People's Committees as decided by the People's Committee, which perform the state management function over the quality of products and goods under the state management responsibility of the Ministry of Home Affairs in the locality and carry out the quality inspection of products and goods within the area under their management in accordance with law;
Importing organizations and individuals shall register for State quality inspection of imported products and goods at the People's Committees at all levels or the specialized agencies of provincial and municipal People's Committees assigned to receive and settle administrative procedures for quality inspection of imported goods.
Article 6. Transitional provisions
1. Certificates of conformity and Notices of receipt of declarations of conformity issued for products and goods within the scope of this Circular before the effective date of this Circular remain valid until the expiry date stated in such Certificate of conformity or Notice of receipt of declaration of conformity.
2. Dossiers of registration for conformity certification received before July 1, 2026 but not yet settled shall continue to be handled under the law in effect at the time the dossier was received.
3. Conformity assessment bodies that have been designated to carry out conformity assessment for group-2 products and goods under the management responsibility of the Ministry of Home Affairs, and whose designation decisions remain valid, may continue to carry out conformity assessment under this Circular until the designation decisions expire.
4. While the National Single Window portal is being adjusted and upgraded to match the List of products and goods of medium risk level and high risk level issued together with this Circular, organizations and individuals importing products and goods on the List shall register for State quality inspection of imported goods on the National Public Service Portal or as guided by the inspection agency. The receipt and processing of dossiers and the return of results of State quality inspection of imported goods shall comply with Decree No. 37/2026/NĐ-CP dated January 23, 2026 of the Government and relevant laws, ensuring that lawful import activities of organizations and individuals are not interrupted.
Article 7. Effect
1. This Circular takes effect from the date of its signing.
2. The following Circulars cease to be effective from the effective date of this Circular:
a) Circular No. 01/2021/TT-BLĐTBXH dated June 3, 2021 of the Minister of Labour, Invalids and Social Affairs prescribing the List of products and goods potentially causing unsafety under the state management responsibility of the Ministry of Labour, Invalids and Social Affairs;
b) Circular No. 26/2018/TT-BLĐTBXH dated December 25, 2018 of the Minister of Labour, Invalids and Social Affairs on quality management of products and goods potentially causing unsafety under the state management responsibility of the Ministry of Labour, Invalids and Social Affairs;
c) Circular No. 13/2024/TT-BLĐTBXH dated December 5, 2024 of the Minister of Labour, Invalids and Social Affairs amending and supplementing a number of articles of Circular No. 26/2018/TT-BLĐTBXH dated December 25, 2018 of the Minister of Labour, Invalids and Social Affairs on quality management of products and goods potentially causing unsafety under the state management responsibility of the Ministry of Labour, Invalids and Social Affairs;
d) Article 16 of Circular No. 09/2025/TT-BNV dated June 18, 2025 of the Minister of Home Affairs on the delimitation of competence and decentralization of the performance of state management tasks in the field of home affairs.
3. Where the legal documents and technical regulations cited in this Circular are amended, supplemented or replaced, the new documents shall apply.
4. Where a national technical regulation for products and goods on the List issued together with this Circular was promulgated before the effective date of this Circular and provides otherwise on quality management measures, this Circular shall apply.
5. Where a national technical regulation is newly promulgated, amended, supplemented or replaces a national technical regulation prescribed in the List of products and goods of medium risk level and high risk level; or a national technical regulation is newly promulgated to apply additionally to products and goods on the List issued together with this Circular, the document promulgating that national technical regulation shall apply from the date such national technical regulation takes effect.
6. For products and goods prescribed in the List issued together with this Circular that have not been listed or assigned an HS code, or for which there are differences or inconsistencies in classification and HS code determination, the HS code shall be determined in accordance with the customs law.
Article 8. Implementation
1. The Department of Employment, Ministry of Home Affairs, shall take the lead and coordinate with relevant agencies, based on actual conditions and management requirements including the emergence of new products and technologies and domestic and international warnings on product and goods risks, to review and submit to the Minister of Home Affairs for consideration the updating and supplementation of the List of products and goods of medium risk level and high risk level within its scope of management, ensuring publicity, transparency and conformity with law;
The Department of Employment shall take the lead and coordinate with agencies and units of the Ministry of Home Affairs in reviewing the national technical regulations corresponding to the products and goods on the List issued together with this Circular; and propose the promulgation, amendment, supplementation or replacement of national technical regulations along an appropriate roadmap, ensuring quality management requirements commensurate with the risk level of the products and goods.
2. People's Committees of provinces and centrally run cities shall organize the dissemination, publicity and guidance for producing and trading organizations and individuals in their areas to implement this Circular; direct specialized agencies and relevant agencies to carry out the management and quality inspection of products and goods on the List of products and goods of medium risk level and high risk level in accordance with law; and compile difficulties and problems arising in the course of implementation and promptly report and propose to the Ministry of Home Affairs for consideration, guidance or amendment and supplementation of the List to suit management practice.
3. In the course of implementation, if any difficulties or problems arise, agencies, organizations and individuals shall report them to the Ministry of Home Affairs for study and settlement./.
