CIRCULAR

PROMULGATING THE HS CODE TABLE FOR GOODS BEING ENDANGERED, PRECIOUS AND RARE FOREST FLORA AND FAUNA, AND ANIMALS AND PLANTS UNDER THE APPENDICES OF THE CONVENTION ON INTERNATIONAL TRADE IN ENDANGERED SPECIES OF WILD FAUNA AND FLORA

Pursuant to Decree No. 105/2022/ND-CP dated December 22, 2022 of the Government defining the functions, duties, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

Pursuant to Decree No. 69/2018/ND-CP dated May 15, 2018 of the Government detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to Decree No. 84/2021/ND-CP dated September 22, 2021 of the Government amending and supplementing a number of articles of Decree No. 06/2019/ND-CP dated January 22, 2019 of the Government on the management of endangered, precious and rare forest flora and fauna and the implementation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora;

At the proposal of the Director of the Forest Protection Department;

The Minister of Agriculture and Rural Development promulgates the Circular promulgating the HS Code Table for goods being endangered, precious and rare forest flora and fauna, and animals and plants under the Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora.

Article 1. Promulgated together with this Circular is the HS Code Table for goods being endangered, precious and rare forest flora and fauna, and animals and plants under the Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora.

Article 2. Effect

1. This Circular takes effect from January 30, 2024.

2. Decision No. 924/QD-BNN-TCLN dated March 24, 2017 of the Minister of Agriculture and Rural Development promulgating the HS Code Table for goods being endangered, precious and rare wild fauna and flora ceases to be effective from the effective date of this Circular.

3. Where a newly issued legal document changes the names of species and groups of species in the List of Endangered, Precious and Rare Forest Flora and Fauna, or in the Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora, that legal document shall apply.

4. Where the HS code or the type of goods changes, the regulations of the Minister of Finance on the Vietnam Export and Import Goods Classification List shall apply.

Article 3. Implementation responsibility

1. The Chief of the Ministry Office, the Director of the Forest Protection Department, the Deputy Ministers, units under the Ministry of Agriculture and Rural Development, and relevant organizations and individuals shall be responsible for implementing this Circular.

2. Difficulties arising during implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for guidance and resolution.
