FINAL REVIEW RESULT OF THE APPLICATION OF ANTI-DUMPING MEASURES AGAINST CERTAIN PLASTIC PRODUCTS MADE FROM PROPYLENE POLYMERS ORIGINATING FROM MALAYSIA, THE KINGDOM OF THAILAND AND THE PEOPLE'S REPUBLIC OF CHINA

Pursuant to Decree No. 86/2025/NĐ-CP dated April 11, 2025 of the Government detailing a number of articles of the Law on Foreign Trade Management on trade remedies;

Pursuant to Decision No. 1317/QĐ-BCT dated June 2, 2023 of the Minister of Industry and Trade on the result of the new-exporter review in the case of application of anti-dumping measures against certain plastic products and products made of plastic from propylene polymers originating from Malaysia, the Kingdom of Thailand and the People's Republic of China;
Pursuant to Decision No. 1945/QĐ-BCT dated July 23, 2024 of the Minister of Industry and Trade on the investigation for the final review of the application of anti-dumping measures against certain plastic products made of plastic from propylene polymers originating from Malaysia, the Kingdom of Thailand and the People's Republic of China;
Pursuant to Decision No. 1068/QĐ-BCT dated April 18, 2025 of the Minister of Industry and Trade on the extension of the time limit for the final review of the application of anti-dumping measures against certain plastic products made of plastic from propylene polymers originating from Malaysia, the Kingdom of Thailand and the People's Republic of China;
At the proposal of the Director General of the Trade Remedies Authority.
DECIDES:
Article 1. To terminate, without extension, the application of anti-dumping measures against certain plastic products made of plastic from propylene polymers as specifically provided for in Decision No. 1900/QĐ-BCT dated July 20, 2020.
Article 2. This Decision takes effect from July 23, 2025.
Article 3. The Chief of the Ministry Office, the Director General of the Trade Remedies Authority and related parties shall be responsible for the implementation of this Decision.

NOTICE
FINAL REVIEW RESULT OF THE APPLICATION OF ANTI-DUMPING MEASURES AGAINST CERTAIN PLASTIC PRODUCTS MADE FROM PROPYLENE POLYMERS ORIGINATING FROM MALAYSIA, THE KINGDOM OF THAILAND AND THE PEOPLE'S REPUBLIC OF CHINA (Attached to Decision No. 2027/QĐ-BCT dated July 14, 2025 of the Minister of Industry and Trade)
1. Basic information
On July 20, 2020, the Ministry of Industry and Trade issued Decision No. 1900/QĐ-BCT on the official application of anti-dumping duties on certain plastic products and products made of plastic from propylene polymers originating from the People's Republic of China, the Kingdom of Thailand and Malaysia.
On July 15, 2022, the Ministry of Industry and Trade issued Decision No. 1403/QĐ-BCT on the result of the first review of the application of anti-dumping measures against certain plastic products and products made of plastic from propylene polymers originating from Malaysia, the Kingdom of Thailand and the People's Republic of China.
Pursuant to Clause 1, Article 62 of Decree No. 10/2018/NĐ-CP dated January 15, 2018 of the Government detailing a number of articles of the Law on Foreign Trade Management on trade remedies, on April 24, 2024, the Ministry of Industry and Trade announced the receipt of applications requesting a final review of the case.
On May 24, 2024, the Ministry of Industry and Trade received the final review request dossier from domestic producing enterprises. After assessing the completeness and validity of this request dossier, the Ministry of Industry and Trade issued Notice No. 71/TB-PVTM dated June 5, 2024 requesting the Requesting Party to supplement and clarify certain information, but did not receive any supplementary documents from the Requesting Party.
Pursuant to Clause 2, Article 82 of the Law on Foreign Trade Management, the Minister of Industry and Trade decided to conduct a review of the application of anti-dumping measures one year before the expiry of the application period of the anti-dumping measures. On that basis, on July 23, 2024, the Ministry of Industry and Trade issued Decision No. 1945/QĐ-BCT on the investigation for the final review of the application of anti-dumping measures against certain plastic products made of plastic from propylene polymers originating from Malaysia, the Kingdom of Thailand and the People's Republic of China.
As required, the Investigating Authority sent questionnaires to domestic producers, importers and foreign producing/exporting enterprises. The review investigation questionnaire was publicly posted on the websites of the Investigating Authority and the Ministry of Industry and Trade.
During the period from March 19 to April 26, 2025, the Investigating Authority conducted on-site verification of domestic producers who responded to the questionnaire in order to verify the information and figures provided in the questionnaire responses.
2. Final review conclusion
The investigation contents were carried out in accordance with the law on trade remedies. The specific results of the review investigation are as follows:
2.1. Goods subject to the review of the application of anti-dumping duties
a) Description of goods
The goods subject to investigation are certain plastic products and products made of plastic from propylene polymers with a thickness ranging from 10 microns to 80 microns and a width ranging from 115mm to 7800mm.
These products fall under HS codes 3920.20.10 and 3920.20.91.
b) Origin of imported goods: the People's Republic of China, the Kingdom of Thailand and Malaysia.
2.2. Final review conclusion
Pursuant to Article 117 of Decree No. 86/2025/NĐ-CP dated April 11, 2025, which provides: "Cases of investigation into the application of trade remedies, review of the application of trade remedies, investigation into the application of anti-circumvention measures against trade remedies, and review of the application of anti-circumvention measures against trade remedies for which the Investigating Authority has announced the receipt of a complete and valid request dossier for investigation or review before the effective date of this Decree shall be handled in accordance with Decree No. 10/2018/NĐ-CP dated January 15, 2018 of the Government detailing a number of articles of the Law on Foreign Trade Management on trade remedies."
Accordingly, pursuant to Articles 23, 24 and 63 of Decree No. 10/2018/NĐ-CP dated January 15, 2018 detailing a number of articles of the Law on Foreign Trade Management on trade remedies, the Investigating Authority determines:
There is no evidence or basis to prove the possibility that the domestic industry would suffer material injury if the application of the anti-dumping measures in this case were terminated.
There is no causal relationship between the likelihood of dumping or subsidization and the likelihood of injury suffered by the domestic industry.
Thus, the Investigating Authority concludes that there is no likelihood that the domestic industry would suffer material injury or be threatened with material injury if the application of the anti-dumping measures is terminated.
Pursuant to Clause 2, Article 82 of the Law on Foreign Trade Management and Clause 2, Article 64 of Decree No. 10/2018/NĐ-CP dated January 15, 2018 detailing a number of articles of the Law on Foreign Trade Management on trade remedies, the Minister of Industry and Trade decided to terminate, without extension, the application of anti-dumping measures against the goods under investigation.
