CIRCULAR
PROVIDING FOR THE IMPLEMENTATION OF RULES OF ORIGIN UNDER THE FREE TRADE AGREEMENT BETWEEN VIET NAM AND THE EURASIAN ECONOMIC UNION
Pursuant to the Government's Decree No. 95/2012/ND-CP dated November 12, 2012, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government's Decree No. 19/2006/ND-CP dated February 20, 2006, detailing the Commercial Law regarding origin of goods;
In implementation of the Free Trade Agreement between Viet Nam and the Eurasian Economic Union, formally signed in Kazakhstan on May 29, 2015.
At the proposal of the Director of the Import-Export Department,
The Minister of Industry and Trade promulgates the Circular providing for the implementation of rules of origin under the Free Trade Agreement between Viet Nam and the Eurasian Economic Union.
Article 1. Scope of regulation and subjects of application
1. This Circular provides for the implementation of rules of origin under the Free Trade Agreement between Viet Nam and the Eurasian Economic Union (hereinafter referred to as the VN - EAEU FTA).
2. This Circular applies to agencies, organizations and individuals engaged in activities related to origin of goods under the VN - EAEU FTA.
Article 2. Rules of origin under the VN - EAEU FTA
Issued together with this Circular are the following Appendices guiding the implementation of the rules of origin under the VN - EAEU FTA:
1. Rules of origin (Appendix I);
2. Product Specific Rules (Appendix II);
3. List of island states referred to in Article 10 of Appendix I (Appendix III);
4. Form of the Certificate of Origin form EAV, the supplementary declaration sheet of the Certificate of Origin form EAV and instructions for completing the Certificate of Origin (Appendix IV);
5. List of Viet Nam's Certificate of Origin issuing bodies (Appendix V).
Article 3. Procedures for the issuance and verification of the Certificate of Origin form EAV
The procedures for the issuance and verification of the Certificate of Origin shall comply with Appendix I issued together with this Circular; Circular No. 06/2011/TT-BCT dated March 21, 2011 of the Ministry of Industry and Trade providing the procedures for issuing preferential Certificates of Origin, and Circular No. 01/2013/TT-BCT dated January 3, 2013 of the Ministry of Industry and Trade amending and supplementing Circular No. 06/2011/TT-BCT dated March 21, 2011.
Article 4. Implementation provisions
This Circular takes effect from October 5, 2016./.
