CIRCULAR
PROMULGATING THE LIST OF GOODS IMPORTED AND EXPORTED IN THE FIELD OF PRINTING AND PUBLICATION DISTRIBUTION
Pursuant to the Publishing Law dated November 20, 2012;
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to Decree No. 17/2017/NĐ-CP dated February 17, 2017 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;
Pursuant to Decree No. 195/2013/NĐ-CP dated November 21, 2013 of the Government detailing a number of articles of and measures for implementing the Publishing Law;
Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing a number of articles of the Law on Foreign Trade Management;
Pursuant to Decree No. 60/2014/NĐ-CP dated June 19, 2014 of the Government on printing activities;
Pursuant to Decree No. 25/2018/NĐ-CP dated February 28, 2018 of the Government amending and supplementing a number of articles of Decree No. 60/2014/NĐ-CP dated June 19, 2014 of the Government on printing activities;
At the proposal of the Director of the Publishing, Printing and Distribution Department,
The Minister of Information and Communications promulgates the Circular promulgating the List of goods imported and exported in the field of printing and publication distribution.
Article 1. List of goods imported and exported in the field of printing and publication distribution
Promulgated together with this Circular is the List of goods imported and exported in the field of printing and publication distribution, including:
1. Appendix 01: List of goods by HS code and management form applicable to goods imported and exported in the field of printing.
2. Appendix 02: List of goods by HS code and management form applicable to goods imported and exported in the field of publication distribution.
Article 2. Implementation provisions
1. This Circular takes effect from February 12, 2019 and replaces the following Circulars:
a) Circular No. 16/2015/TT-BTTTT dated June 17, 2015 of the Minister of Information and Communications detailing the implementation of Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government on the export and import of goods in the field of printing and publication distribution;
b) Circular No. 41/2016/TT-BTTTT dated December 26, 2016 of the Minister of Information and Communications amending and supplementing a number of articles of Circular No. 16/2015/TT-BTTTT dated June 17, 2015 of the Minister of Information and Communications detailing the implementation of Decree No. 187/2013/NĐ-CP dated November 20, 2013 of the Government on the export and import of goods in the field of printing and publication distribution.
2. The Chief of Office, the Director of the Publishing, Printing and Distribution Department, heads of agencies and units under the Ministry of Information and Communications; agencies, organizations and individuals participating in or related to the import and export of goods in the field of printing and publication distribution are responsible for implementing this Circular.
3. In the course of implementation, if any difficulties arise, they should be promptly reported to the Ministry of Information and Communications (via the Publishing, Printing and Distribution Department) for guidance, consideration and resolution.

2. The order, procedures and dossiers for granting import permits for goods in the List under Section I.1 shall comply with Articles 27 and 28 of Decree No. 60/2014/NĐ-CP dated June 19, 2014 of the Government on printing activities (as amended and supplemented by Decree No. 25/2018/NĐ-CP dated February 28, 2018 of the Government).
3. Goods in the field of printing with HS codes under headings 84.40, 84.41, 84.42 and goods under heading 84.43 specified in Circular No. 65/2017/TT-BTC dated June 27, 2017 of the Ministry of Finance but not listed in the List under Section I.1 shall not require an import permit from the Ministry of Information and Communications when imported.
II. Exported goods
Goods in the List under Section I.1, when exported, are not required to have an export permit from the Ministry of Information and Communications.

2. The order, procedures and dossiers for confirming the import registration of publications for business purposes for goods in the List under Section I.1 shall comply with Article 39 of the Publishing Law and Circular No. 23/2014/TT-BTTTT dated December 29, 2014 of the Minister of Information and Communications detailing and guiding the implementation of a number of articles of the Publishing Law and Decree No. 195/2013/NĐ-CP dated November 21, 2013 of the Government detailing a number of articles of and measures for implementing the Publishing Law.
3. The order, procedures and dossiers for granting import permits for non-business publications for goods in the List under Section I.1 shall comply with Article 41 of the Publishing Law and Circular No. 23/2014/TT-BTTTT dated December 29, 2014 of the Minister of Information and Communications detailing and guiding the implementation of a number of articles of the Publishing Law and Decree No. 195/2013/NĐ-CP dated November 21, 2013 of the Government detailing a number of articles of and measures for implementing the Publishing Law.
4. Goods in the List under Section I.1 that are not required to obtain an import permit under Clauses 1 and 2, Article 42 of the Publishing Law shall not be subject to the management form under this Circular.
5. Goods in the List under Section I.1 whose content violates the provisions of Clause 1, Article 10 of the Publishing Law are prohibited from import in any form.
II. Exported goods
1. Goods in the List under Section I.1 that have been lawfully published and circulated in Vietnam may be exported abroad under Article 43 of the Publishing Law and are not required to have an export permit from the Ministry of Information and Communications.
2. Goods in the List under Section I.1 whose content violates the provisions of Clause 1, Article 10 of the Publishing Law are prohibited from export in any form.
