CIRCULAR

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 01/2018/TT-BCT DATED FEBRUARY 27, 2018 OF THE MINISTER OF INDUSTRY AND TRADE PROVIDING DETAILED REGULATIONS ON GOODS TRADED AND EXCHANGED THROUGH BORDER SUB-GATES AND BORDER OPENINGS BY TRADERS

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to Decree No. 40/2025/ND-CP dated February 26, 2025 of the Government defining the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 14/2018/ND-CP dated January 23, 2018 of the Government detailing border trade activities;

Pursuant to Decree No. 122/2024/ND-CP dated October 4, 2024 of the Government amending and supplementing a number of articles of Decree No. 14/2018/ND-CP;

At the proposal of the Director General of the Import and Export Department,

The Minister of Industry and Trade promulgates the Circular amending and supplementing a number of articles of Circular No. 01/2018/TT-BCT dated February 27, 2018 of the Minister of Industry and Trade providing detailed regulations on goods traded and exchanged through border sub-gates and border openings by traders.

Article 1. Annulment of Point c, Clause 2, Article 3, and replacement of Appendix I of Circular No. 01/2018/TT-BCT dated February 27, 2018 of the Minister of Industry and Trade providing detailed regulations on goods traded and exchanged through border sub-gates and border openings by traders

1. To annul Point c, Clause 2, Article 3 of Circular No. 01/2018/TT-BCT.

2. To replace Appendix I issued together with Circular No. 01/2018/TT-BCT with the Appendix issued together with this Circular.

Article 2. Implementation provisions

This Circular takes effect from July 21, 2025./.

LIST OF GOODS TRADED AND EXCHANGED BY TRADERS THROUGH BORDER SUB-GATES AND BORDER OPENINGS OUTSIDE BORDER-GATE ECONOMIC ZONES

I. Application principles

1. Where a 2-digit HS code is listed, it applies to all 8-digit HS codes under this Chapter.

2. Where a 4-digit HS code is listed, it applies to all 8-digit HS codes under this 4-digit heading.

3. Where a 6-digit HS code is listed, it applies to all 8-digit HS codes under this 6-digit subheading.

4. Where an HS code is listed up to 8 digits, it applies only to that specific 8-digit HS code.
