CIRCULAR

PROMULGATING THE LIST OF PRODUCTS AND GOODS WITH MEDIUM RISK LEVEL, HIGH RISK LEVEL UNDER THE MANAGEMENT RESPONSIBILITY OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

Pursuant to the Law on Product and Goods Quality No. 05/2007/QH12, as amended and supplemented by Law No. 78/2025/QH15;

Pursuant to the Law on Standards and Technical Regulations No. 68/2006/QH11, as amended and supplemented by Law No. 35/2018/QH14 and Law No. 70/2025/QH15;

Pursuant to the Law on Telecommunications No. 24/2023/QH15;

Pursuant to the Law on Radio Frequencies No. 42/2009/QH12, as amended and supplemented by Law No. 09/2022/QH15;

Pursuant to Decree No. 37/2026/NĐ-CP dated January 23, 2026 of the Government detailing the implementation of a number of articles and measures for organizing and guiding the implementation of the Law on Product and Goods Quality;

Pursuant to Decree No. 22/2026/NĐ-CP dated January 16, 2026 of the Government detailing the implementation of a number of articles and measures for organizing and guiding the implementation of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 55/2025/NĐ-CP dated March 2, 2025 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;

At the proposal of the Chairperson of the National Committee for Standards, Metrology and Quality;

The Minister of Science and Technology promulgates the Circular promulgating the List of products and goods with medium risk level and high risk level under the management responsibility of the Ministry of Science and Technology.

Article 1. Scope of regulation

This Circular provides for the List of products and goods with medium risk level and high risk level under the management responsibility of the Ministry of Science and Technology, together with the corresponding HS codes in accordance with Vietnam's Export and Import Goods Classification and the corresponding quality management requirements.

Article 2. Subjects of application

This Circular applies to:

1. Organizations and individuals that manufacture, import, or trade in products and goods on the List of products and goods with medium risk level and high risk level within the territory of Vietnam.

2. Agencies, units, organizations and individuals engaged in activities related to the quality management of products and goods on the List of products and goods with medium risk level and high risk level within the territory of Vietnam.

Article 3. List of products and goods with high risk level

The List of products and goods with high risk level and the corresponding quality management requirements are provided as follows:

1. The List of products and goods with high risk level is provided in Appendix I issued together with this Circular.

2. The corresponding quality management requirements for products and goods with high risk level are provided in Appendix I issued together with this Circular.

3. For products and goods with high risk level, the test results serving as the basis for conformity certification must be obtained from a testing organization that is accredited, designated by the Ministry of Science and Technology, or recognized in accordance with the law on standards and technical regulations and the law on product and goods quality, and whose testing scope is consistent with the corresponding national technical regulation.

The recognition of test results shall be carried out in accordance with the law on standards and technical regulations.

Article 4. List of products and goods with medium risk level

The List of products and goods with medium risk level and the corresponding quality management requirements are provided as follows:

1. The List of products and goods with medium risk level is provided in Appendix II issued together with this Circular.

2. The corresponding quality management requirements for products and goods with medium risk level are provided in Appendix II issued together with this Circular.

3. For products and goods with medium risk level, the test results serving as the basis for self-assessment or conformity certification must be obtained from a testing organization that is accredited, designated by the Ministry of Science and Technology, or recognized in accordance with the law on standards and technical regulations and the law on product and goods quality, and whose testing scope is consistent with the corresponding national technical regulation.

The recognition of test results shall be carried out in accordance with the law on standards and technical regulations.

Article 5. Principles for managing products and goods with medium risk level and high risk level under the management responsibility of the Ministry of Science and Technology

1. The quality management of products and goods on the List of products and goods with medium risk level and high risk level shall be carried out in accordance with the law on product and goods quality, standards and technical regulations; the regulations of the Ministry of Science and Technology on conformity certification, conformity announcement, and quality inspection of products and goods; and the corresponding national technical regulations.

2. Where products and goods on the List issued together with this Circular are simultaneously subject to two or more national technical regulations, they must fully satisfy the corresponding national technical regulations; conformity assessment, conformity certification, and conformity announcement shall be carried out according to the risk level and corresponding quality management requirements set out in the List issued together with this Circular, the corresponding national technical regulations, and the law on product and goods quality and on standards and technical regulations; duplication of conformity assessment content for the same technical requirement already assessed under the corresponding national technical regulation must be avoided.

3. Where a national technical regulation issued before the effective date of this Circular contains different provisions on quality management requirements for products and goods on the List issued together with this Circular, the provisions of this Circular shall apply.

4. Where a national technical regulation is newly issued, amended, supplemented, or replaces a national technical regulation specified in the List of products and goods with medium risk level and high risk level; or a national technical regulation is newly issued to additionally apply to products and goods on the List issued together with this Circular, the provisions of the document promulgating that national technical regulation shall apply from the time the national technical regulation takes effect.

5. Products and goods with medium risk level and high risk level in the field of atomic energy, including radioactive materials, nuclear equipment, and radiation equipment, shall be managed in accordance with the law on atomic energy; Clauses 2 and 3 of Article 3 and Clauses 2 and 3 of Article 4 of this Circular shall not apply to products and goods under the specialized management scope of atomic energy.

Article 6. Effect

1. This Circular takes effect from July 1, 2026.

2. The following documents cease to be effective from the effective date of this Circular:

a) Circular No. 29/2025/TT-BKHCN dated November 13, 2025 of the Minister of Science and Technology providing the List of products and goods potentially causing unsafety in the information technology and telecommunications sector under the management responsibility of the Ministry of Science and Technology;

b) Circular No. 30/2011/TT-BTTTT dated October 31, 2011 of the Ministry of Information and Communications promulgating regulations on conformity certification and conformity announcement for products and goods in the information and communications technology sector;

c) Circular No. 15/2018/TT-BTTTT dated November 15, 2018 of the Ministry of Information and Communications amending and supplementing a number of provisions of Circular No. 30/2011/TT-BTTTT dated October 31, 2011 of the Minister of Information and Communications promulgating regulations on conformity certification and conformity announcement for products and goods in the information and communications technology sector, effective from January 1, 2019;

d) Circular No. 10/2020/TT-BTTTT dated May 7, 2020 of the Ministry of Information and Communications amending and supplementing a number of provisions of Circular No. 30/2011/TT-BTTTT dated October 31, 2011 of the Minister of Information and Communications promulgating regulations on conformity certification and conformity announcement for products and goods in the information and communications technology sector;

đ) Joint Circular No. 58/2015/TTLT-BCT-BKHCN dated December 31, 2015 of the Minister of Industry and Trade and the Minister of Science and Technology on the quality management of domestically manufactured steel and imported steel;

e) Circular No. 01/2009/TT-BKHCN dated March 20, 2009 of the Ministry of Science and Technology providing the List of products and goods potentially causing unsafety under the management responsibility of the Ministry of Science and Technology.

3. Where a legal document, national technical regulation, or HS code specified in Vietnam's Export and Import Goods Classification referenced in this Circular is amended, supplemented, or replaced, the amending, supplementing, or replacing document shall apply, unless that document contains different transitional provisions.

Article 7. Transitional provisions

1. Certificates of conformity and Notices of receipt of conformity announcement issued before the effective date of this Circular for products and goods within the scope of regulation of this Circular remain valid until the expiry date stated in the Certificate of conformity or the Notice of receipt of conformity announcement. The monitoring of the continued validity of Certificates of conformity issued before the effective date of this Circular shall continue to be carried out in accordance with the regulations in effect at the time of issuance of the Certificate of conformity.

2. Applications for conformity certification received before July 1, 2026 but not yet completed shall continue to be processed in accordance with the law in effect at the time of receipt of the application. Products and goods for which registration for state inspection of the quality of imported goods was made before the effective date of this Circular shall continue to be processed in accordance with the law in effect at the time of receipt of the application.

3. Conformity assessment organizations that have been designated to perform conformity assessment for group-2 products and goods under the management responsibility of the Ministry of Science and Technology and the former Ministry of Information and Communications (now the Ministry of Science and Technology), whose designation decisions remain valid, may continue to perform conformity assessment for products and goods with high risk level and medium risk level, and the certification methods provided in Appendix I and Appendix II issued together with this Circular, until the expiry of the validity period of the designation decision.

4. During the period when the National Single Window Portal is being adjusted and upgraded to conform with the List of products and goods with medium risk level and high risk level issued together with this Circular, organizations and individuals importing products and goods on the List shall register for state inspection of the quality of imported goods on the National Public Service Portal or as guided by the inspecting agency. The receipt, processing of applications, and return of results of state inspection of the quality of imported goods shall be carried out in accordance with Decree No. 37/2026/NĐ-CP dated January 23, 2026 of the Government and other relevant legal provisions, ensuring no disruption to the lawful import activities of organizations and individuals.

5. Applications for designation of conformity assessment organizations received before July 1, 2026 but not yet completed shall continue to be processed in accordance with the law in effect at the time of receipt of the application.

Article 8. Implementation organization

1. The Chief of Office, the Chairperson of the National Committee for Standards, Metrology and Quality, the heads of agencies and units under the Ministry of Science and Technology, and relevant organizations and individuals are responsible for implementing this Circular.

2. The review, proposal for updating and supplementing the List of products and goods with medium risk level and high risk level under the management scope of the Ministry of Science and Technology shall be carried out in accordance with Decree No. 37/2026/NĐ-CP and practical management requirements.

3. The National Committee for Standards, Metrology and Quality shall:

a) Preside over and coordinate with agencies and units under the Ministry of Science and Technology to review the national technical regulations corresponding to the products and goods on the List issued together with this Circular; propose the new issuance, amendment, supplementation, or replacement of national technical regulations according to an appropriate roadmap, ensuring quality management requirements commensurate with the risk level of the products and goods;

b) Organize the state inspection of the quality of imported goods with high risk level specified in Appendix I of this Circular for gasoline, diesel fuel, biofuel, and liquefied petroleum gas (LPG) in accordance with the law on product and goods quality and the assignment and guidance of the Ministry of Science and Technology;

c) Preside over and coordinate with agencies and units under the Ministry of Science and Technology to develop and submit to the Minister of Science and Technology for promulgation regulations and a roadmap for implementing traceability for products and goods with high risk level specified in Appendix I issued together with this Circular.

4. Provincial and municipal People's Committees shall:

a) Organize the implementation of this Circular in their localities according to their assigned functions, tasks, and authority;

b) Direct the specialized agency for science and technology and other relevant agencies to manage and inspect the quality of products and goods on the List issued together with this Circular in accordance with the law. The specialized agency for science and technology under the provincial-level People's Committee shall organize the state inspection of the quality of imported goods with high risk level specified in Appendix I issued together with this Circular (except gasoline, diesel fuel, biofuel, and liquefied petroleum gas (LPG)) in accordance with the law on product and goods quality and the guidance of the Ministry of Science and Technology;

c) Compile difficulties and obstacles arising in the course of implementation and promptly send them to the Ministry of Science and Technology for consideration, guidance, or amendment and supplementation of the List to suit practical management needs.

5. In the course of applying this Circular, organizations and individuals shall promptly report difficulties and obstacles to the Ministry of Science and Technology for consideration and guidance.

- Central Committee of the Vietnam Fatherland Front;

- Central agencies of socio-political organizations;

- People's Committees of centrally-run provinces and cities;

- Departments of Science and Technology of centrally-run provinces and cities;

- Department of Document Inspection and Law Enforcement Organization;

- Department of Administrative Procedure Control - Ministry of Justice;

- Official Gazette; Government Electronic Information Portal; National Legal Portal;

APPENDIX II

LIST OF PRODUCTS AND GOODS WITH MEDIUM RISK LEVEL UNDER THE MANAGEMENT RESPONSIBILITY OF THE MINISTRY OF SCIENCE AND TECHNOLOGY (Issued together with Circular No. 36/2026/TT-BKHCN dated June 30, 2026 of the Minister of Science and Technology)

Notes:

- The conformity assessment method and the principles for applying the certification method shall be carried out in accordance with Circular No. 14/2026/TT-BKHCN dated April 9, 2026 of the Minister of Science and Technology on standard conformity announcement, conformity announcement, and methods for assessing conformity with standards and technical regulations.

- Products and goods with radio frequency emission functions must comply with Vietnam's radio frequency planning and allocation, the corresponding technical and operating conditions, as well as the current legal provisions on radio frequencies.

- Organizations and enterprises manufacturing, importing, distributing, or using products and goods must commit to properly complying with the law on the management and use of radio frequencies.

- The implementation of conformity certification and conformity announcement for products and goods listed in Section II of Appendix I and Section II of Appendix II for certain specific cases shall be as follows:

(1) For this technical regulation, products and goods are not required to undergo conformity certification but only conformity announcement.

(2) This type of product or goods does not apply to explosion-proof communication equipment.

(3) Short-range radio equipment in this section does not include radio receive-only equipment; broadband data transmission equipment operating in the 2.4 GHz band with equivalent isotropically radiated power (EIRP) of less than 60 mW; radio access equipment in the 5 GHz band with equivalent isotropically radiated power (EIRP) of less than 60 mW; broadband data transmission equipment and independent radio access equipment operating in the 6 GHz band (5.925 GHz to 6.425 GHz); and Bluetooth and Zigbee equipment with equivalent isotropically radiated power (EIRP) of less than 60 mW.

(4) For QCVN 117:2023/BTTTT: the requirements on Total Radiated Sensitivity (TRS) of the receiver in Article 2.2.12, Section B.2.2.18, and Total Radiated Power (TRP) in Article 2.2.13, Section B.2.2.19 of the technical regulation do not apply; the technical requirements for GSM technology (2G and 2.5G) do not apply.

(5) For QCVN 101:2020/BTTTT: only the conformity announcement of the safety characteristic requirements specified in Article 2.6 of this technical regulation is mandatory.

(6) For QCVN 65:2021/BTTTT: in Article 2.1.2 of QCVN 65:2021/BTTTT, Formula (1) of the technical regulation does not apply.

(7) For QCVN 128:2021/BTTTT: the Performance Requirements for 5G Base Stations in Article 2.4 do not apply. When applying QCVN 128:2021/BTTTT, equipment supporting the n77 and n78 bands must apply the requirements in Appendix D of QCVN 128:2021/BTTTT, except for the spurious emission limit requirement in Section D.4 of QCVN 128:2021/BTTTT.

(8) For QCVN 131:2022/BTTTT: the requirements on Total Radiated Sensitivity (TRS) of the receiver in Article 2.2.12 and Total Radiated Power (TRP) in Article 2.2.13 of the technical regulation do not apply.

(9) Test/measurement results from domestic or foreign testing laboratories that have not been designated or recognized, or test/measurement results from the manufacturer, may not be used for conformity assessment against this technical regulation.

(10) For QCVN 132:2022/BTTTT: where products or goods use a voltage adapter, if the voltage adapter is included, testing under QCVN 132:2022/BTTTT shall be conducted for the product or goods together with the voltage adapter; if the voltage adapter is not included, testing under QCVN 132:2022/BTTTT shall be conducted for the product or goods without the voltage adapter.

(11) For QCVN 133:2024/BTTTT: the requirements on Equivalent Isotropically Radiated Power (EIRP) in Article 2.2.2.7 and Receiver Sensitivity OTA (EIS) in Article 2.2.2.13 of the technical regulation do not apply.

(12) Where products or goods specified in Section II of Appendix I issued together with this Circular are integrated into products or goods specified in Section II of Appendix II issued together with this Circular, the integrated product or goods shall be subject to the quality management measures applicable to products and goods with medium risk level, but must fully satisfy the corresponding national technical regulations applicable to the main product or goods and to the integrated components, parts, or functions.

Relevant organizations and individuals must carry out conformity certification or self-assessment of conformity with the corresponding technical regulation, and conformity announcement, in accordance with the law on standards and technical regulations, the law on product and goods quality, and the corresponding national technical regulation.

(13) For products and goods applying Method 3 under Circular No. 14/2026/TT-BKHCN, the certification organization is exempted from assessing the production process at the manufacturing site if the product is manufactured on a production line already certified as conforming to a quality management system standard that remains valid and whose scope is consistent with the product or goods being assessed; this applies to both domestically manufactured products and imported goods. The sampling for testing and conformity assessment shall be carried out in accordance with Circular No. 14/2026/TT-BKHCN, the corresponding national technical regulation, and the law on product and goods quality.
