              d) Ensuring the principle of proportionality, with State management requirements commensurate with the risk level;

              dd) Applying the precautionary principle in cases of serious risk to human health and life, the environment or national security where there is not yet sufficient scientific evidence.

              2. Risk classification:

              Products and goods are classified into three risk levels:

              a) High-risk group: products and goods with a high level of hazardous risk and a high likelihood of risk occurring, which may cause serious or especially serious consequences if there are no appropriate management measures;

              b) Medium-risk group: products and goods with a medium level of hazardous risk or a medium likelihood of risk occurring, which may cause significant effects if there are no appropriate management measures;

              c) Low-risk group: products and goods with a low level of hazardous risk or a low likelihood of risk occurring, which almost never cause significant effects under normal control or use conditions.

              3. Method for determining the quantitative risk level

              The method for determining the quantitative risk level of products and goods is prescribed in Appendix VI of this Decree. Article 5. Order and dossier for determining the risk level of products and goods

              1. Within 06 months from the date this Decree takes effect, the quality management of products and goods continues to be carried out under the national technical regulations already issued, relevant current legal provisions, and the List of products and goods currently applied.

              2. On the basis of the principles, methods and order for determining risk levels prescribed in this Decree, sectoral and field management ministries are responsible for reviewing and assessing the risk level of products and goods within their management scope; and for issuing the List of products and goods with medium and high risk levels, accompanied by HS codes consistent with the Vietnam Export and Import Tariff Schedule, linked to corresponding quality management requirements, ensuring effect from 01 July 2026. Sectoral and field management ministries are responsible for issuing new, or amending and supplementing, national technical regulations corresponding to the products and goods on the List specified in this Clause on an appropriate roadmap, ensuring consistency and convenience for subjects in the course of use.

              3. When determining products and goods with medium and high risk levels, sectoral and field management ministries must ensure that:

The Ministry of Science and Technology takes the lead and coordinates in supervising the determination and management of risks, ensuring consistency and no overlap between sectoral and field management ministries.

              6. Sectoral and field management ministries, based on actual conditions and management requirements, including the emergence of new products and technologies and domestic and international warnings on the risks of products and goods, review, update and supplement the List of products and goods with medium and high risk levels within their management scope, ensuring publicity, transparency and conformity with legal provisions.

              b) Exploiting and using the data uniformly in developing the List of products and goods with medium and high risk levels, and in market supervision and inspection;

              c) For products and goods containing State secrets, it is not required to update information or report inspection, supervision and post-circulation inspection (post-inspection) results on the database.

              i) Radioactive substances, electric energy, goods used in emergencies to remedy natural disasters and epidemics; rail, waterway and air transport means.

              3. Goods in loose, liquid or gaseous form without commercial packaging, contained in cargo containers, ship holds or tank trucks, need not carry a goods label but must be accompanied by dossiers and documents showing in full the mandatory contents in Vietnamese under this Decree and relevant legal provisions, in place of the goods label.

              Where the accompanying dossiers and documents are in a language other than Vietnamese, a Vietnamese translation must be attached.

              4. Where specialised law or an international treaty to which the Socialist Republic of Vietnam is a party has provisions different from those of this Decree, the provisions of that specialised law or international treaty apply.

              Article 36. Position of goods labels

              1. Goods labels must be shown on the goods or the commercial packaging of the goods in a position where the label content prescribed can be easily and fully recognised on observation without having to take apart components or parts of the goods.

              The mandatory contents to be written on the goods label need not be shown together on the label; they may be written in other positions on the goods, ensuring that they can be easily and fully recognised on observation without having to take apart components or parts of the goods. Those mandatory contents are part of the goods label.

              For special goods such as paintings, statues, art ceramics and sculptures, where the goods label cannot be shown in an easily visible position on the goods or the commercial packaging of the goods, the goods label is shown on a loose tag accompanying the goods, or on the back or underside of the goods.

              2. Goods that have both direct packaging and outer packaging are labelled under the following principles:

              a) Goods on the market that have outer packaging and whose small goods units with direct packaging inside are not sold separately must be labelled on the outer packaging;

              b) Goods on the market that have outer packaging and whose small goods units with direct packaging inside are also separated for retail must be fully labelled on both the outer packaging and the direct packaging.

              Where the outer packaging must not or cannot be opened, the outer packaging must carry a label, and the label must fully present the mandatory content.

              Where the outer packaging is transparent so that the product labelling content inside can be observed, labelling of the outer packaging is not required.

              Article 37. Size of goods labels, and size of letters and numbers on labels

              The organisation or individual responsible for goods labelling determines the size of the goods label and the size of letters and numbers shown on the goods label, but must ensure the following requirements:

              1. The mandatory content under Clauses 1 and 2, Article 42 of this Decree can be written in full.

              2. The size of letters and numbers must be sufficient to be read with the naked eye. The size of letters and numbers showing measurement quantities must comply with the law on metrology.

              3. Where goods of small size or packaging of small size cannot show all the mandatory content, the contents specified at Points a, b and c, Clause 1, Article 42 of this Decree must be written on the goods or the goods packaging by a physical label. The remaining contents are shown in accompanying documents or on an electronic label. Goods of small size or packaging of small size are goods or packaging that cannot show all the mandatory content at a minimum font size of 0.9 mm.

              4. Where imported goods of small size cannot show all the mandatory content at a minimum font size of 0.9 mm, the contents specified in Clause 2, Article 42 of this Decree must be written on the goods packaging by a physical label.

              Article 38. Colour of letters, symbols and images on goods labels

              The colour of letters, digits, drawings, images, signs and symbols written on goods labels must be clear. For mandatory contents as prescribed, the letters and digits must be in a colour contrasting with the background colour of the goods label.

              Article 39. Language of presenting goods labels

              1. Mandatory contents shown on labels of goods circulating on the Vietnamese market must be written in Vietnamese, except for exported goods not consumed domestically and except the cases specified in Clause 4 of this Article.

              The proper names of organisations and individuals and place names written on labels of goods circulating on the Vietnamese market must not be abbreviated. Words denoting administrative units may be abbreviated.

              The name of the country or territory producing the goods or of the place where the final stage of finishing the goods is carried out, written on labels of goods circulating on the Vietnamese market, must not be abbreviated.

              2. For goods produced and circulated domestically, in addition to complying with Clause 1 of this Article, the content shown on the label may also be written in another language; the content in another language need not be a full translation of the Vietnamese, must not contradict or distort the Vietnamese content, and must not cause misunderstanding about the nature, uses or origin of the goods; the font size of the other language must not be larger than the font size of Vietnamese.

              3. For goods imported into Vietnam whose label does not yet show, or does not fully show, the mandatory content in Vietnamese, a supplementary label showing the mandatory content in Vietnamese must be provided and the original label of the goods must be kept intact. The content written in Vietnamese must correspond to the content written on the original label.

              4. The following contents may be written in other languages of Latin alphabet origin:

              a) International names or scientific names where there is no Vietnamese name;

              b) International names or scientific names accompanied by chemical formulas or structural formulas of chemicals, active pharmaceutical ingredients, excipients and ingredients of medicines;

              e) Names of cultural and artistic products, names of authors and art troupes.

              Article 40. Supplementary labelling

              1. Supplementary labels are used for exported goods specified in Clause 4, Article 42 and imported goods specified in Clause 2, Article 42 of this Decree.

              2. The supplementary label must be affixed to the goods or the commercial packaging of the goods and must not cover the mandatory content of the original label under Vietnamese law.

              The supplementary label may be shown as an electronic label under Chapter IV of this Decree, but the original label of the goods must be kept intact and clearly indicated so that consumers can recognise it.

              3. The content written on the supplementary label is content translated into Vietnamese from the mandatory content written on the original label, together with other missing mandatory content according to the nature of the goods under this Decree. The labelling organisation or individual is responsible for the accuracy and truthfulness of the content written. The content written on the supplementary label, including supplementary content, must not cause misunderstanding of the content on the original label and must correctly reflect the nature and origin of the goods.

              4. The following goods need not carry a supplementary label:

              a) Imported components to replace damaged components in the goods warranty service of the organisation or individual responsible for the goods or of an authorised professional warranty service provider, not sold on the market;

              Article 41. Responsibility for goods labelling

              1. The organisation or individual responsible for goods labelling, including supplementary labelling, must ensure truthful, clear and accurate labelling that correctly reflects the nature of the goods.

              2. For goods produced for domestic circulation, the producing organisation or individual is responsible for goods labelling.

              Where the organisation or individual responsible for goods labelling asks another organisation or individual to carry out the labelling, it remains responsible for its goods label.

              Where an organisation or individual commissions the contract manufacture of products and goods according to its own requirements and quality standards, the commissioning organisation or individual is responsible for goods labelling and is responsible for the goods and the goods labelling content. The organisation or individual carrying out the contract manufacture may label according to the requirements of the commissioning party but is not the organisation or individual responsible for the goods label.

              3. Where exported goods cannot be exported or are returned and put into circulation on the market, the organisation or individual putting the goods into circulation must label them under this Decree.

              4. Organisations and individuals importing goods into Vietnam must label them under the provisions on mandatory content shown on labels of imported goods in this Decree.

              a) Ensuring that goods traded on the platform have their labelling information fully declared, and publicly displaying the goods label and electronic label (if any) when listing products and goods for sale;

              b) Providing and sharing the minimum data to connect with the National Database on standards, metrology and quality, including: information on organisations and individuals trading on the platform; data on goods labels; and feedback from consumers relating to goods labels and the quality of products and goods;

              c) Fully, safely and securely storing data on goods labels and related information in the course of trading on the platform, including information on sellers, electronic contracts, vouchers, invoices, documents proving the legality of goods labels, documents declaring and certifying quality, and transaction data. The minimum storage period is 05 years to serve inspection, examination, handling of violations and dispute settlement under law.

              Where goods have properties falling under multiple groups prescribed in Appendix I issued with this Decree and not yet prescribed in other relevant legal normative documents, the organisation or individual responsible for the goods, based on the main use of the goods, determines the group of the goods itself in order to write the contents under this point.

              2. The original label of goods imported into Vietnam must be shown as a physical label with the following contents in a foreign language or Vietnamese when carrying out customs clearance procedures:

              a) Name of the goods;

              b) Origin of the goods;

              Where the origin cannot be determined, the place where the final stage of finishing the goods is carried out is written under Clause 3, Article 47 of this Decree;

              For goods imported into Vietnam with a foreign-language original label under Points a, b and c, Clause 2 of this Article, the importing organisation or individual must supplement the goods label written in Vietnamese under Clause 1 of this Article before putting the goods into circulation on the Vietnamese market.

              3. Labels of exported goods are made under the law of the importing country, contracts, and international treaties to which Vietnam is a party, while complying with Clause 2, Article 50 of this Decree.

              4. Where exported goods cannot be exported, or exported goods are returned but meet the conditions to be put into circulation on the Vietnamese market, the manufacturer must carry out labelling as for goods produced for domestic circulation, or carry out supplementary labelling as for imported goods for domestic circulation under this Decree, before putting the goods into circulation on the market.

              Article 43. Name of goods

              1. The name of the goods must be in an easily visible and readable position on the goods label. The letters of the goods name must be the largest in size compared with the other mandatory contents on the goods label.

              2. The name of the goods written on the label is given by the organisation or individual responsible for the goods. The name of the goods must not mislead about the nature, uses and ingredients of the goods.

              3. Where the name of an ingredient is used as the name or part of the name of the goods, that ingredient must be stated with its quantity, except the case specified in Clause 4, Article 45 of this Decree.

              Where the conformity assessment organisation has had its capacity assessed by another sectoral and field management ministry and has been given a designation decision, when carrying out on-site assessment, the designating agency recognises the result of assessing the corresponding quality management system for that type of conformity assessment organisation. Recognition of assessment results is valid only for 12 months from the date the competent authority issued the most recent assessment result.

              For temporary designation or changing, supplementing or narrowing, if the registration dossier is complete and valid, the designating agency appraises the dossier without organising an on-site capacity assessment. Where the registration dossier is complete but has inappropriate content, or there is a request from the competent State agency, or there is information or feedback on signs of violation relating to the dossier, the designating agency organises an on-site capacity assessment at the conformity assessment organisation.

              On-site capacity assessment at the conformity assessment organisation must be notified in writing to the conformity assessment organisation that submitted the registration dossier. The expert, or at least 01 member of the on-site capacity assessment team, must be trained in the quality management system corresponding to each type of conformity assessment organisation requesting designation. At the end of the assessment, the expert or assessment team established by the designating agency must sign an on-site assessment record and send the record to the designating agency within 05 days.

              Where the conformity assessment organisation must remedy the contents stated in the on-site assessment record, it must send a report on the results of the corrective action to the designating agency within not more than 30 days. Where the contents to be remedied require an extended time limit, the conformity assessment organisation reports to the designating agency in writing, clearly stating the official time limit for completing the remedy of the above contents; the time for sending the report on the results of the corrective action to the designating agency must not exceed 06 months.

              Within 05 working days from the date of receiving the report on the results of corrective action under the on-site assessment record, if the conformity assessment organisation meets the requirements as prescribed, the designating agency issues a designation decision for the conformity assessment organisation as prescribed in Form No. 10 of Appendix VII issued with this Decree. Based on the capacity of the conformity assessment organisation, the sectoral and field management ministry decides the validity period of the designation decision, but not more than 05 years from the date of signing and issuance. Where designation is refused, the designating agency must notify the conformity assessment organisation of the reasons in writing.

              c) Content of the on-site assessment:

              The level of compliance with the provisions of the law on product and goods quality, the law on standards and technical regulations, and relevant specialised management provisions by the conformity assessment organisation is assessed under the following contents:

              For an organisation requesting first-time designation: assess the meeting of capacity conditions, the management system and the conformity of the legal dossier under law; the compliance content in conformity assessment activities is not assessed because no activity has yet arisen.

              For an organisation currently operating that requests re-designation or expansion of the designated scope: assess legal compliance based on the following documents: the organisation's report on the results of conformity assessment activities in the most recent 03 years or during its operating time if it has operated for less than 03 years; records of handling violations (if any); and supervision results of management agencies and accreditation bodies (if any).

              Verify the accuracy, truthfulness and completeness of the designation registration dossier provided by the conformity assessment organisation. In addition, for testing organisations, verify the actual state of facilities, testers, testing equipment, and professional and technical skills for the corresponding test methods.

              The costs serving the assessment activities of the expert or assessment team are borne by the conformity assessment organisation registering for designation, under the principles of openness and transparency and in compliance with the law on finance. The list of costs serving assessment activities includes travel and accommodation costs, expert hire costs (if any), costs of on-site assessment and other valid costs under regulations of the Ministry of Finance and specialised law. The expenditure level is determined under the current financial expenditure regime.

              2. Reissuance of the designation decision:

              During the validity period of the designation decision, a conformity assessment organisation wishing to register for reissuance of the designation decision prepares 01 set of dossier requesting reissuance under Article 73 of this Decree and submits it as an online public service via the National Public Service Portal. Within 05 working days from receiving a complete and valid dossier, the designating agency considers and reissues the designation decision. Where the requirements are not met, the designating agency replies, clearly stating the reasons.

              Where the designation decision is reissued because the designation decision was lost, torn, damaged or contained errors of information but this does not change the capacity or operating scope of the conformity assessment organisation, the reissued designation decision retains the remaining validity period of the designation decision already issued.

              3. Where the conformity assessment organisation requests a change of information or supplement of its operating scope or field, the sectoral and field management ministry considers the corresponding capacity to decide the validity period of the designation decision, but not more than 05 years from the date of signing and issuance.

              4. 60 days before the designation decision expires, if it so wishes, the conformity assessment organisation carries out the procedure for requesting re-designation under this Decree as for first-time designation.

              5. Where the conformity assessment organisation has a change in capacity relating to technical personnel, equipment, processes or the quality management system in the course of operation, the organisation must notify the sectoral and field management ministry in writing. The notification dossier includes:

              a) A document clearly stating the content of the change;

              b) Documents proving capacity after the change (personnel records, equipment records, updated processes);

              c) An internal assessment report on the impact of the change;

              d) Other documents as required by the sectoral and field management ministry.

              The sectoral and field management ministry considers the dossier, assesses the appropriateness of the change (on-site assessment if necessary), and decides on approving the change, adjusting the designated scope, or requiring the conformity assessment organisation to remedy. The assessment and updating of information are carried out under law.

              Article 76. Revocation of decisions designating conformity assessment organisations

              1. The sectoral and field management ministry considers and decides to revoke the designation decision where the conformity assessment organisation commits one of the following violations:

              a) Violating the provisions on conformity assessment under the law on standards and technical regulations and the provisions of this Decree 02 consecutive times;

              b) Failing to fully perform the corresponding responsibilities specified in Article 77 of this Decree for 02 consecutive years;

              c) Failing to ensure one of the corresponding conditions for designated conformity assessment organisations under this Decree;

              d) Forging or falsely declaring documents in the designation registration dossier; issuing conformity assessment results without actual assessment;

              dd) Erasing or altering the content of the issued designation decision so as to distort it;

              e) Failing to remedy violations as required by the inspection or examination agency;

              g) The conformity assessment organisation no longer operates within the designated scope, is dissolved, or has its decision revoked at its own request.

              2. A conformity assessment organisation that has had its designation decision revoked may have its designation registration dossier considered only after at least 06 months from the revocation notice and after remedying the violations.

              3. The order and procedures for revoking the designation decision are as follows:

              a) Within 03 working days, the competent authority issues a decision revoking the designation decision, clearly stating the reasons for revocation;

              b) The revocation decision must be sent to the relevant organisation and published on the web portal of the competent authority, and also updated on the National Database on standards, metrology and quality.

              4. Where the reason for revocation is also an administrative violation specified in the Decree on penalties for administrative violations in the field of standards, metrology and product and goods quality, the competent authority:

              a) Issues a decision revoking the designation decision;

              b) Transfers the dossier to the inspection agency to handle and impose administrative penalties within proper authority and under the order and procedures prescribed in the law on penalties for administrative violations.

              5. Where the reason for revocation is not an administrative violation (the organisation voluntarily withdraws, does not maintain capacity after the assessment cycle, etc.), the competent authority issues only the revocation decision, and no administrative penalty is applied.

              Article 77. Responsibilities of designated conformity assessment organisations

              1. Exercise rights and perform obligations under the law on standards and technical regulations. Where the provisions of this Decree or the law on standards and technical regulations are violated, depending on the nature and level of the violation, the organisation will be considered and handled under law.

              A designated testing organisation must, during the validity period of the designation decision, participate in a proficiency testing or inter-laboratory comparison programme at least once for the testing field and the products and goods for which it has been designated.

              2. Periodically each quarter before the 25th, or on an ad hoc basis when requested, update the results of designated conformity assessment activities, as prescribed in Form No. 13 of Appendix VII issued with this Decree, on the National Database on standards, metrology and quality.

              3. Notify the designating agency of every change affecting the capacity for designated conformity assessment activities within 15 days from the date of the change.

              Section 3. STATE INSPECTION OF PRODUCT AND GOODS QUALITY AND QUALITY SURVEYS OF GOODS CIRCULATING ON THE MARKET

              Article 78. Application of technology and exploitation of the national database in inspecting and surveying product and goods quality

              1. Central and local agencies inspecting the quality of products and goods are responsible for:

              a) Encouraging the use of advanced technologies such as artificial intelligence (AI) to analyse data and forecast risks, and the Internet of Things (IoT) and blockchain technology to collect and exchange data automatically, in order to support automatic post-inspection and quality surveys of products and goods circulating on the market;

              b) Exploiting, updating and sharing inspection and survey data on the quality of products and goods with the National Database on standards, metrology and quality under guidance of the Ministry of Science and Technology;

              c) Strengthening the carrying out of inspection on digital platforms to improve the effectiveness of inspection and supervision of product and goods quality.

              2. The Ministry of Science and Technology is responsible for:

              a) Developing, operating, managing, updating and ensuring the connection and data sharing capability between the National Database on standards, metrology and quality and central and local agencies inspecting the quality of products and goods;

              b) Guiding, training and supporting inspecting agencies at all levels in applying technology and exploiting national data to serve inspection and surveys of the quality of products and goods; training and coaching the inspection and examination force in using the national product and goods quality supervision system.

              Article 79. State inspection of product quality in production

              1. State inspection of the quality of products and goods in production (hereinafter abbreviated as inspection of product and goods quality in production) is carried out by the agency inspecting the quality of products and goods.

              2. Each year, the inspecting agency develops and prepares a plan for inspecting the quality of products and goods in production based on the risk level of the products and goods, data in the National Database on standards, metrology and quality, and the following contents:

              a) Information on exported goods not conforming to Article 32 of the Law on Product and Goods Quality as amended and supplemented in Clause 18, Article 1 of Law No. 78/2025/QH15, leading to importing countries applying measures restricting the import of goods from Vietnam;

              b) Information on systematic non-conformity of goods circulating on the market with the declared applicable standard and the corresponding technical regulation;

              c) Results of analysing and processing data from the warning system, surveys, and consumer feedback and complaints; traceability data and conformity assessment dossiers;

              d) Information and warnings from State agencies, social organisations participating in consumer protection, professional social organisations, conformity assessment organisations and other social supervision channels;

              dd) Information on producing organisations and individuals applying advanced management system standards appropriate to the field of production and trading of products and goods;

              e) Management requirements of the competent authority.

              3. Inspection content:

              a) Inspecting the implementation of the requirements prescribed in the corresponding standards and technical regulations or provisions on ensuring product quality relating to the conditions of the production process and State management measures on product quality in production;

              b) Inspecting the implementation of conformity assessment results, goods labelling, use of marks of conformity to standards and technical regulations, and the documents accompanying the product to be inspected;

              c) Testing samples at a testing organisation designated under law to check the conformity of the product with the declared applicable standard and the corresponding technical regulation.

              Inspection under the content specified at this point is carried out when signs of failure to ensure quality are detected after carrying out the contents specified at Points a and b of this Clause, and is carried out through testing performed by a designated conformity assessment organisation.

              4. The inspecting agency may invite experts or representatives of conformity assessment organisations, but must ensure independence and objectivity, and bears legal responsibility for the assessment results.

              Article 80. Establishment and operation of the Inspection Team

              1. The Inspection Team is established by a document of the inspecting agency specified in Clause 3, Article 45 of the Law on Product and Goods Quality as amended and supplemented in Clause 20, Article 1 of Law No. 78/2025/QH15 when carrying out inspection of product and goods quality as prescribed.

              2. The Inspection Team consists of:

              a) The Team Leader, being the person assigned to carry out inspection of product and goods quality at the agency inspecting product and goods quality specified in Clause 3, Article 45 of the Law on Product and Goods Quality as amended and supplemented in Clause 20, Article 1 of Law No. 78/2025/QH15;

              b) Members, including: quality inspectors and relevant officials, civil servants, public employees and technical experts (if necessary);

              c) The secretary of the Inspection Team.

              3. The Inspection Team is responsible for:

              a) Inspecting dossiers, documents and data relating to the quality of products and goods, and conducting on-site inspection;

              b) Sampling and supervising the testing of samples as prescribed;

              c) Making the inspection record and proposing handling measures;

              d) Being responsible for the accuracy and objectivity of the inspection results.

              4. Operating funds of the Inspection Team are guaranteed from the State budget according to decentralisation or from other valid funding sources under law.

              5. Funds for sampling and testing samples are as prescribed in Clause 2, Article 47 of the Law on Product and Goods Quality as amended and supplemented in Clause 20, Article 1 of Law No. 78/2025/QH15.

              Payment and settlement are carried out under the law on the State budget and the law on finance and accounting.

              6. On sampling

              In the course of inspection at production, import and circulation establishments, sampling to serve the inspection of product and goods quality is carried out as follows:

              a) Sampling is carried out under the standard on sampling methods, under the provisions on sampling methods in the corresponding technical regulation (if any) or relevant legal provisions. Where there is no standard, provision on sampling methods in the corresponding technical regulation, or legal provision on sampling methods, then depending on the nature of the products and goods, sectoral and field management ministries prescribe sampling for products and goods managed by the ministry or sector;

              b) In the course of inspection, where goods are not in sufficient quantity for sampling under Point a of this Clause or the lot of products and goods cannot be determined, the Inspection Team takes survey samples of the quality of products and goods under Point a, Clause 2, Article 91 of this Decree;

              c) Samples of products and goods, once taken, must be sealed (under Form No. 14 of Appendix VII attached to this Decree), and a sampling record (under Form No. 15 of Appendix VII attached to this Decree) must be made, signed by the person taking the sample and the representative of the sampled establishment. The handover of samples to the testing organisation must have a sample handover record (under Form No. 16 of Appendix VII attached to this Decree), and the testing organisation must confirm the seal is intact before receiving the test sample;

              d) Where products and goods have no separate provision on the time for sending samples for testing, within at most 05 working days from the date of sampling, the inspection team must send the product and goods samples to a testing organisation designated under law for testing. The designated testing organisation is responsible for giving priority to testing samples of products and goods of inspection teams performing State management functions, ensuring the sample testing time is as prescribed.

              Article 81. Order, procedures and handling of violations in the course of inspecting the quality of products and goods in production

              The order, procedures and handling of violations in the course of inspecting the quality of products and goods in production are prescribed as follows:

              1. Announcing the inspection decision;

              2. Collecting, reviewing and assessing information, dossiers and documents under the contents specified in Clause 3, Article 80 of this Decree;

              3. Making the inspection record and the administrative violation record, and handling the inspection results under the law on specialised inspection and the law on handling of administrative violations.

              Article 82. State inspection of the quality of imported goods

              1. For imported goods on the list of products and goods with a medium risk level, before putting the goods into circulation on the market, the importing organisation or individual is not required to carry out quality inspection upon import but must declare conformity to the corresponding national technical regulation or carry out the quality management measure prescribed in other relevant laws under the principle specified in Clause 2, Article 48 of the Law on Standards and Technical Regulations as amended and supplemented in Clause 19, Article 1 of Law No. 70/2025/QH15. Declaration of conformity to technical regulations is carried out under the law on standards and technical regulations.

              2. For imported goods on the list of products and goods with a high risk level, the importing organisation or individual must register for quality inspection under Article 83 of this Decree.

              3. For products and goods on the list of products and goods with medium and high risk levels that have been granted a circulation licence or have undergone a corresponding quality management measure stated in the list under specialised law, it is not necessary to carry out the inspection of imported goods quality under Clauses 1 and 2 of this Article; the provisions of specialised law apply instead.

              Article 83. Order and procedures for quality inspection of imported goods with a high risk level

              1. Where imported goods already have a Certificate of conformity to technical regulations

              a) The importing organisation or individual registers for State inspection of the quality of imported goods as prescribed with the agency inspecting the quality of products and goods (hereinafter abbreviated as the inspecting agency). The registration dossier includes:

              Registration for State inspection of the quality of imported goods under Form No. 1 of Appendix VII issued with this Decree;

              A Certificate of conformity to technical regulations issued by a designated conformity assessment organisation, containing information relating to the imported goods. Where the Certificate of conformity is issued for a consignment, it must contain information relating to the imported consignment (name of the goods; trademark, type; technical characteristics; origin, manufacturer; weight/quantity; import goods declaration; invoice);

              A photo or description of the characteristics of the goods accompanied by the content of the main label (for goods required to be labelled);

              A sample of the supplementary label (if the main label does not yet have the full content as prescribed), for goods required to be labelled.

              Where an electronic label is used, the labelling must meet the law on goods labels. The importing organisation or individual is responsible for the validity of the import dossier.

              b) The inspecting agency carries out inspection and handling in the following order:

              Receive the dossier registering for quality inspection of imported goods under Form No. 2 of Appendix VII issued with this Decree.

              Where the dossier is incomplete, the inspecting agency confirms the missing contents, and at the same time confirms on the inspection registration form that the importing organisation or individual has registered for quality inspection of imported goods, and requests the importing organisation or individual to supplement and complete the dossier within 07 working days from the date of receiving the dossier. If after that time limit the dossier has still not been fully supplemented, the importing organisation or individual must send a document to the inspecting agency clearly stating the reasons and the expected time for completing the supplementation of the dossier.

              The subsequent inspection steps are carried out only after the importing organisation or individual has fully completed the dossier. The order is as follows:

              Where the dossier is complete and conforming: within 01 working day from the date the dossier is complete and valid, the inspecting agency issues a Notice of the result of State inspection of the quality of imported goods meeting quality requirements under Form No. 3 of Appendix VII issued with this Decree, sent to the importing organisation or individual to carry out customs clearance procedures;

              Where the dossier is complete but does not meet label requirements: the inspecting agency requires the importing organisation or individual to remedy within not more than 05 working days. The inspecting agency issues the Notice that the consignment meets quality requirements only when there is evidence proving that the label has been remedied as prescribed. Where it cannot be remedied, the inspecting agency issues a Notice of the result of State inspection of the quality of imported goods not meeting label requirements under Form No. 3 of Appendix VII;

              Where the dossier is complete but the Certificate of conformity to technical regulations does not conform to the corresponding technical regulation or does not match the dossier of the imported consignment: the inspecting agency issues a Notice of the result of State inspection of the quality of imported goods not meeting quality requirements, clearly stating the non-conforming contents, and sends it to the importing organisation or individual and the customs authority for handling within their authority;

              Where the importing organisation or individual fails to fully complete the dossier within the prescribed time limit: within 01 working day from the end of the time limit for supplementing the dossier, the inspecting agency issues a Notice of the result of State inspection of the quality of imported goods under Form No. 3 of Appendix VII, clearly stating: “The consignment has not completed its dossier in full”, sent to the importing organisation or individual and the customs authority;

              Where signs of risk or fraud, or inconsistent information between the dossier and management data, are detected, the inspecting agency issues a Notice of the result of quality inspection of imported goods not meeting requirements under Form No. 3 of Appendix VII issued with this Decree.

              2. Where imported goods do not yet have a Certificate of conformity to technical regulations

              a) The importing organisation or individual registers for State inspection of the quality of imported goods as prescribed with the agency inspecting the quality of products and goods (hereinafter abbreviated as the inspecting agency). The registration dossier includes: registration for State inspection of the quality of imported goods under Form No. 1 of Appendix VII issued with this Decree; a photo or description of the characteristics of the goods accompanied by the content of the main label (for goods required to be labelled); and a sample of the supplementary label (if the main label does not yet have the full content as prescribed), for goods required to be labelled.

              Where the dossier is incomplete, the inspecting agency confirms the missing contents, and at the same time confirms that the importing organisation or individual has registered for quality inspection of imported goods, and requests the importing organisation or individual to supplement and complete the dossier within 07 working days from the date of receiving the dossier.

              If after that time limit the dossier has still not been fully supplemented, the importing organisation or individual must send a document to the inspecting agency clearly stating the reasons and the expected time for completing the supplementation of the dossier.

              The organisation or individual carries out procedures with the customs authority to bring the imported goods to the goods storage place under the law on customs.

              The organisation or individual contacts a designated certification body to carry out conformity assessment to the corresponding national technical regulation.

              The subsequent inspection steps are carried out only after the importing organisation or individual has fully completed the dossier. The order is carried out as prescribed at Point b, Clause 1 of this Article.

              3. Principles of application for bringing goods to the storage place

              Permission to bring imported goods to the storage place specified in Clauses 1 and 2 of this Article applies uniformly to cases of imported goods that must undergo quality inspection, ensuring conformity with the law on customs and the risk management principle and not creating new administrative procedures.

              4. The procedure for registering for State inspection of the quality of imported goods is carried out on the National Single Window Portal or the National Public Service Portal.

              Where these systems have an incident or in cases of force majeure making it impossible to exchange electronic information, handling is carried out under Article 17 of Decree No. 85/2019/ND-CP dated 14 November 2019 of the Government on the national single window mechanism, the ASEAN single window and specialised inspection of exported and imported goods.

              5. Imported goods with a high risk level are permitted to be cleared through customs and circulated on the market after the inspecting agency issues a Notice of the result of State inspection of the quality of imported goods meeting quality requirements, and are also subject to quality inspection under Article 88 of this Decree.

              6. Quality testing of imported goods with a high risk level is carried out at a testing organisation designated under law. The test results of the designated testing organisation are the basis for assessing conformity to the corresponding national technical regulation.

              Where the corresponding test method has not been prescribed or is not unified, or there is no designated testing organisation yet, the Minister of the sectoral and field management ministry decides on a temporary test method to apply until a national technical regulation is issued or an appropriate testing organisation is designated.

              Article 84. Increasing the frequency of quality inspection of imported goods

              1. Imported goods specified in Clause 4, Article 34 of the Law on Product and Goods Quality, as amended and supplemented in Clause 19, Article 1 of Law No. 78/2025/QH15, must be subject to enhanced inspection measures when they fall within one of the following cases:

              a) Goods already subject to the measure of exemption from or reduction of quality inspection under Article 86 of this Decree but whose inspection in circulation on the market yields results not conforming to the declared applicable standard or the corresponding national technical regulation;

              b) Imported goods originating from a country or territory on a list of high-risk quality warnings announced by the competent authority;

              c) The importing organisation or individual has a history of repeated violations of the law on product and goods quality, as assessed by the inspecting agency.

              2. Increasing the frequency of State inspection of the quality of imported goods with a high risk level is carried out as follows:

              a) Inspecting agencies under sectoral and field management ministries are responsible for:

              Monitoring, compiling, updating and announcing the list of countries and territories warned as having a high risk level for the quality of imported products and goods on the National Single Window Portal or the specialised information system as prescribed;

              Collecting, managing and updating information on the compliance history of importing organisations and individuals to serve the classification of risk levels in quality inspection;

              Organising the implementation of the measure of increasing inspection frequency for imported goods under this Article and relevant provisions.

              Consolidating the information in this Clause to determine, announce and update the list of organisations and individuals not eligible for continued application of the reduced inspection regime on the national product and goods quality supervision system.

              Where sectoral and field management ministries use a specialised information system or the National Single Window Portal, these systems must be connected and automatically share data with the national product and goods quality supervision system, ensuring consistent, non-duplicated data.

              b) The customs authority clears goods on the basis of looking up and using information and data on the list of organisations and individuals not eligible for continued application of the reduced inspection regime on the national product and goods quality supervision system;

              c) The application of increased inspection frequency must not create new administrative procedures and must ensure no lengthening of customs clearance time, except where handling measures must be applied under law.

              Article 85. Handling of violations in the course of quality inspection of imported goods with a high risk level

              1. Where imported goods already have a valid certificate of conformity to technical regulations but do not meet requirements on goods labels or the mark of conformity to technical regulations, the agency inspecting the quality of products and goods requires the importing organisation or individual to take remedial measures.

              The issuance of the Notice of the result of State inspection of the quality of imported goods meeting quality requirements is carried out only after the importer provides full evidence of remedy and the certificate of conformity to technical regulations for the consignment.

              2. Where imported goods have a certificate of conformity to technical regulations that does not match the dossier of the imported consignment or does not conform to the corresponding technical regulation, the inspecting agency handles under law and coordinates with the customs authority to handle within authority when requested.

              3. For violating goods with recycling as the remedial measure:

              a) The conformity assessment organisation carries out conformity assessment of the recycled consignment;

              b) Where the recycled consignment has results conforming to the corresponding technical regulation, the inspecting agency issues a Notice of the result of State inspection of the quality of imported goods meeting quality requirements so that the importer carries out customs clearance procedures;

              c) Where the recycled consignment does not conform to the corresponding technical regulation, the inspecting agency issues a Notice of the result of State inspection of the quality of imported goods not meeting quality requirements and sends it to the importer and the customs authority for handling as prescribed.

              4. The importer is responsible for sending evidence of remedying the consequences to the inspecting agency within 01 working day from the date of completing the remedy.

              5. Imported goods, after customs clearance, are permitted to circulate on the market and are subject to quality inspection under Article 88 of this Decree.

              Article 86. Exemption from and reduction of quality inspection of imported goods with a high risk level; no need to repeat the declaration of conformity to technical regulations for imported goods with a medium risk level

              1. Goods with a high risk level are exempt from quality inspection upon import in the following cases:

              a) Luggage of organisations and individuals entering the country, and relocated property of organisations and individuals within the tax-exempt allowance (excluding motor vehicles, specialised motor machinery and electric bicycles);

              d) Goods temporarily imported for display and introduction at trade fairs and exhibitions, not sold off after the exhibition and not put into circulation on the market;

              dd) Gifts and presents within the tax-exempt allowance (excluding motor vehicles, specialised motor machinery and electric bicycles);

              e) Goods exchanged by border residents within the tax-exempt allowance;

              g) Goods, supplies, equipment and machinery temporarily imported for re-export and not consumed in Vietnam;

              h) Goods in transit, re-exported goods, and transit goods;

              i) Materials, supplies and samples for processing for foreign parties, for producing export goods, or for temporary import and re-export; materials for producing goods consumed domestically or circulating on the market where the goods are already quality-managed under the corresponding national technical regulation; imported goods in small quantities insufficient for taking test samples as prescribed in national technical regulations;

              k) Goods traded duty-free to departing passengers (managed under the temporary import – re-export regime);

              l) Goods re-imported for repair or recycling at the request of a foreign partner;

              m) Imported goods serving urgent requirements under the direction of the Government or the Prime Minister;

              u) Goods on the list of goods prohibited from import under the law on foreign trade management.

              2. Exemption from quality inspection does not apply to imported goods falling within one of the following cases:

              a) Goods with a safety warning according to a notice from the competent authority of Vietnam or a relevant international organisation;

              b) Goods on a list of specially controlled goods issued by the sectoral and field management ministry;

              c) Goods classified as high risk under other specialised laws that require mandatory inspection upon import.

              3. Reduced State inspection of the quality of imported goods with a high risk level is carried out as follows:

              a) Imported goods with a high risk level are subject to the reduced State quality inspection regime when they fully meet the following requirements and do not fall within the cases specified in Clause 2 of this Article:

              Goods with the same name, use, trademark, type, technical characteristics, manufacturing establishment and origin, imported by the same organisation or individual;

              Having 03 consecutive imports with a Notice of the result of State inspection of the quality of imported goods meeting quality requirements.

              The enterprise itself determines that it meets the requirements for reduced inspection and itself keeps proving records to serve post-inspection.

              b) Method of applying the reduced quality inspection regime to imported goods with a high risk level:

              The application of the reduced quality inspection regime to imported goods with a high risk level is carried out on the basis of risk management, through the exchange, sharing and use of information and data between the inspecting agency and the customs authority; it is not prescribed as an administrative procedure.

              The importing organisation or individual fully and accurately declares on the customs declaration the goods identification codes and corresponding identifying information, including: HS code; numbers and barcodes; serial number and model; information on the manufacturer and country of origin; and other identifying information under the law on customs and relevant law, and is responsible before law for the accuracy of the declared information.

              The inspecting agency is responsible for determining, updating and announcing the list of importing organisations and individuals subject to the reduced quality inspection regime; the period of applying the reduced inspection regime is 02 years, counted from the time the conformity assessment result of the third import arises; and for cases where the reduced inspection regime is stopped when a violation or sign of risk arises, on the specialised management information system, the National Single Window Portal as prescribed, and the national product and goods quality supervision system.

              The customs authority clears goods on the basis of looking up and using information and data on the list of importing organisations and individuals subject to the reduced inspection regime provided and updated by the inspecting agency.

              The exchange, sharing and interconnection of data among the customs electronic data processing system under the national single window mechanism, the information systems of sectoral and field management ministries, and the national product and goods quality supervision system are carried out on a roadmap consistent with technical infrastructure conditions. While the national product and goods quality supervision system is not yet fully operational, the application of the reduced inspection regime is carried out on the basis of data and information managed, provided and updated by the inspecting agency as prescribed.

              The application of the reduced quality inspection regime does not create new administrative procedures and does not lengthen customs clearance time, except where handling measures must be applied under law.

              c) Management, supervision and post-inspection:

              Enterprises submit a periodic report every 03 months on the import of goods eligible for reduced inspection to serve post-inspection and quality supervision;

              The inspecting agency carries out post-inspection according to plan or on an ad hoc basis when there are signs of violation, risk warnings, complaints or denunciations, or at the request of the customs authority;

              Post-inspection activities must not affect the progress of customs clearance of goods.

              d) The inspecting agency stops applying the reduced inspection regime to an enterprise in the following cases:

              Goods circulating on the market are determined not to conform to the national technical regulation or the declared applicable standard;

              There are complaints or denunciations about quality or about conformity assessment results that are verified as correct;

              Post-inspection or ad hoc inspection finds that conformity assessment results do not meet requirements;

              The enterprise fails to fully perform its obligation to report or provide information as prescribed.

              4. Responsibilities of inspecting agencies and customs authorities

              a) Inspecting agencies, according to sectoral and field management assignment; the Government Cipher Committee and specialised agencies under provincial People's Committees are responsible for organising supervision and post-inspection of the quality of imported goods under law;

              b) The inspecting agency maintains and updates information on enterprises eligible for reduced inspection in the national product and goods quality supervision system; and coordinates with the customs authority in exchanging and exploiting data to serve risk management;

              c) The inspecting agency is responsible for consolidating information as the basis for applying the reduced inspection regime specified in Clause 2 of this Article, including the list of organisations and individuals subject to the reduced inspection regime; and for fully and promptly updating and sharing information and results of quality inspection of imported products and goods on the national product and goods quality supervision system;

              d) The customs authority looks up and exploits information serving customs procedures on the national product and goods quality supervision system; where data is updated from the National Single Window Portal or the information systems of sectoral and field management ministries, the lookup is carried out through the national product and goods quality supervision system without requiring organisations and individuals to provide the information again.

              5. No need to repeat the declaration of conformity to technical regulations for imported goods with a medium risk level, under the following provisions:

              a) Principle of application

              Imported goods with a medium risk level that have already carried out the declaration of conformity to technical regulations for a previous consignment need not declare again when the next imported goods have the same name, use, trademark, type, technical characteristics, manufacturing establishment and origin;

              The enterprise itself keeps records of the status of declaration of conformity to technical regulations and is responsible for applying the mechanism of not declaring again;

              Where the national technical regulation changes, product characteristics change, or there is a risk warning from the competent authority, the enterprise must carry out the declaration of conformity to technical regulations again as prescribed.

              b) Monitoring and post-inspection

              The enterprise prepares an internal document recording that the goods fall within the case of not needing to declare again, to serve post-inspection;

              The inspecting agency cross-checks the information on declaration of conformity to technical regulations on the National Database on standards, metrology and quality and updates it into the national product and goods quality supervision system within 03 working days from receiving the information provided by the enterprise;

              The updated information is the basis for post-inspection activities and assessment of the enterprise's compliance.

              Article 87. State inspection of the quality of exported goods and handling of violations

              1. Goods meeting the requirements specified in Article 32 of the Law on Product and Goods Quality, as amended and supplemented in Clause 18, Article 1 of Law No. 78/2025/QH15, are permitted to be exported without inspection by the inspecting agency.

              Goods intended only for export must fully comply with the regulations of the importing country and need not comply with regulations for goods circulating domestically; except that goods that are both exported and circulated domestically must fully comply with the regulations of both the importing country and Vietnam.

              2. Where exported goods fail to ensure quality, affecting national interests and prestige, the agency inspecting the quality of products and goods carries out inspection of product quality in production under Article 79 and handles under Article 81 of this Decree.

              3. When exported goods are put into circulation domestically, they must comply with the management requirements specified in Articles 88, 89 and 90 of this Decree.

              Article 88. Inspection of the quality of goods circulating on the market

              1. The grounds for inspecting the quality of goods circulating on the market are as follows:

              b) Based on the inspection plan approved by the competent level, on an ad hoc basis, or where directed by the competent State agency;

              c) Existing data on the risk level of products and goods, traceability information, numbers, barcodes, and certificates of conformity to standards and technical regulations;

              d) Data from accredited quality management systems or systems connected with State management agencies, combined with warnings of violations of the quality of products and goods.

              2. The agency inspecting the quality of products and goods carries out quality inspection of goods circulating on the market under the following contents:

              a) Inspecting compliance with the requirements prescribed by the law on product and goods quality;

              b) After inspecting the requirements specified at Point a of this Clause, if signs of failure to ensure quality are found, take samples and test them at a conformity assessment organisation under law to check the conformity of the goods with the declared applicable standard and the corresponding technical regulation. The conformity assessment organisation must be independent and objective and is responsible before law for its conformity assessment results;

              c) For products and goods with a high risk, in addition to complying with Point b of this Clause, the agency inspecting the quality of products and goods prepares a plan for periodic or ad hoc sampling at appropriate locations according to management requirements, in order to strengthen inspection of these products and goods under Clause 7, Article 45 of the Law on Product and Goods Quality as amended and supplemented in Clause 20, Article 1 of Law No. 78/2025/QH15.

              Article 89. Order and procedures for inspection and handling of violations in the course of inspecting the quality of goods circulating on the market

              The Inspection Team carries out inspection in the following order and procedures:

              1. Announcing the inspection decision.

              3. Making the inspection record and the administrative violation record (for cases with administrative violations), and handling the inspection results under the law on specialised inspection and the law on handling of administrative violations.

              Article 90. Responsibilities of organisations and individuals producing and trading products and goods circulating on the market

              1. Products and goods circulating on the market must ensure no risk to organisations, individuals, animals, plants, property or the environment.

              2. When products and goods circulating on the market are found not to conform to the declared applicable standard or the corresponding technical regulation, or are likely to pose a risk to organisations, individuals, animals, plants, property or the environment, the organisation or individual is responsible for handling and recalling those products and goods and for complying with the requirements of the competent State management agency when requested.

              Article 91. Quality surveys of products and goods

              1. A quality survey of products and goods is an activity carried out independently or integrated into management work, not of the nature of examination, inspection or administrative penalty, aimed at collecting and analysing actual information on the quality of products and goods circulating on the market.

              The survey results are used to serve risk warning, risk-based management, and determining the basis for the competent authority to carry out targeted inspection and post-inspection in order to collect and analyse actual information on the quality of products and goods circulating on the market, serve risk warning, and determine the basis for targeted inspection and post-inspection.

              A survey does not replace inspection activities and does not give rise to responsibility for administrative penalties.

              2. The content of quality survey activities for products and goods includes:

              a) Random sampling of products and goods for testing and conformity assessment solely for reference and risk analysis purposes, not directly used as the basis for penalties but used as the basis for considering and recommending that the competent authority organise inspection and post-inspection under this Decree;

              b) Checking and cross-checking information on goods labels, marks of conformity to standards and technical regulations, numbers, barcodes and traceability;

              c) Comparing and cross-checking the declared applicable information with the actual products and goods in circulation.

              3. Where the survey results show signs that products and goods do not conform to the declared applicable standard or the corresponding technical regulation, pose a possible safety risk, or violate legal provisions, the agency conducting the survey is responsible for transferring the full dossier and results to the agency inspecting the quality of products and goods. The inspecting agency decides on organising inspection and post-inspection under this Decree.

              4. Responsibilities of sectoral and field management ministries:

              a) Organising periodic or ad hoc quality survey activities for groups of products and goods within their management scope;

              b) Analysing and assessing survey results to warn of risks, prevent violations and improve quality management policies;

              c) Sharing survey data with the agencies inspecting the quality of products and goods and relevant State management agencies through the National Database on standards, metrology and quality.

              5. Responsibilities of provincial People's Committees:

              6. For products and goods with a high risk level, the inspecting agency carries out periodic or ad hoc sampling through the Survey Team at production locations, storage warehouses, points of sale or other locations consistent with management requirements, in order to strengthen inspection as prescribed.

              Article 92. Survey Team

              1. The Survey Team is established under a decision of the agency inspecting the quality of products and goods when carrying out quality surveys of products and goods as prescribed.

              4. Operating funds of the Survey Team are guaranteed from the State budget according to decentralisation or other valid funding sources under law.

              5. Surveys are carried out according to the annual plan or practical requirements when there are signs of failure to ensure quality, risks arise, or at the request of the State management agency.

              Article 94. State management responsibilities of sectoral and field management ministries

              1. The assignment of product and goods quality management ensures the following principles:

              a) One product or good is assigned to one sectoral and field management ministry to take the lead in quality management based on the nature and technical characteristics of the product;

              b) Where a product has multiple uses, the assignment is determined by technical nature, not by use;

              c) Where products and goods have technical characteristics relating to multiple fields or an overlap among specialised laws making it difficult to determine the sectoral and field management ministry to take the lead in quality management, the Ministry of Science and Technology takes the lead in coordinating with relevant ministries to agree on an assignment plan; where there is no agreement, the Ministry of Science and Technology reports to the Prime Minister for consideration and decision.

              g) For goods traded on digital platforms serving electronic transactions, the Ministry of Industry and Trade is responsible for managing owners of intermediary digital platforms serving electronic transactions; requiring these subjects to fully display information on goods quality as prescribed and to have a mechanism for screening and removing violating products. Ministries with sectoral and field management functions are responsible for taking the lead, in coordination with the Ministry of Industry and Trade, in carrying out post-inspection and handling quality violations for goods in the fields they manage that are traded on digital platforms.

              3. Sectoral and field management ministries are responsible for performing State management of product and goods quality prescribed in this Law within the scope and fields assigned by the Government.

              I. The risk level of products and goods is determined on the basis of assessing the following factors:

              1. The impact level is a factor determined through:

              a) The severity of the impact;

              b) The capacity to recover after the impact; and

              c) The ability to control, mitigate or eliminate the hazard under actual conditions.

              2. The impact coefficient is a factor determined through:

              a) The aggregate index of effects on the affected subjects, being humans, the environment, animals, plants and the supply chain; and

              b) The scale of impact.

              3. The likelihood of occurrence is a factor determined through:

              a) The frequency of occurrence when used or operated under actual conditions;

              b) The repeatability of events; and

              c) The management and supervision conditions and the legal compliance capacity of the producing and trading organisation or individual.

              4. The risk level is quantified through determining a risk score. The assessment and determination of the risk score are prescribed in detail in this Appendix.

              II. Techniques for assessing the risk of products and goods

              The risk assessment of products and goods is carried out on the basis of applying risk assessment techniques according to the following criteria:

              1. Impact on human and animal health and plant growth

              a) Capacity to cause toxicity, irritation or allergy, or to affect genes, cells, the endocrine system, the nervous system and reproduction; capacity to create risks of mechanical, electrical, and fire and explosion hazards;

              b) Negative effects on vulnerable groups such as children, the elderly, people with underlying conditions, and pregnant women;

              c) Capacity to cause epidemics and parasitic infection;

              d) Capacity to cause radio interference, exposure to electromagnetic fields, radiation, sound waves and other safety risks.

              2. Impact on the environment

              a) Capacity to cause pollution of air, water sources, light, soil and noise throughout the product life cycle;

              b) Risk of bioaccumulation, dispersal of hazardous substances, or effects on ecosystems, biodiversity, and energy and resource consumption.

              c) Capacity to cause insecurity of information and telecommunications systems.

              3. Controllability in the supply chain

              a) A complex, cross-border or non-transparent supply chain;

              b) Difficulty in internal control, traceability, and inspection and supervision of the quality of products and goods;

              c) Widely counterfeited or easily counterfeited, substituted or altered during transport, storage and distribution.

              4. Warning information from competent authorities and international organisations:

              a) Warnings and recommendations of the World Health Organization (WHO), the Food and Agriculture Organization of the United Nations (FAO), the Organisation for Economic Co-operation and Development (OECD), the International Organization for Standardization (ISO), the International Electrotechnical Commission (IEC), the United Nations Economic Commission for Europe (UNECE), the EU Rapid Alert System for dangerous products (RAPEX), the International Telecommunication Union (ITU), the Asia-Pacific Telecommunity (APT), etc.;

              b) Data on incidents, recalls and quality violations in Vietnam or internationally;

              c) Domestic and foreign inspection and examination results.
