CIRCULAR
PROVIDING FOR THE IMPLEMENTATION OF RULES OF ORIGIN UNDER THE VIET NAM - KOREA FREE TRADE AGREEMENT
Pursuant to the Government's Decree No. 95/2012/ND-CP dated November 12, 2012, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government's Decree No. 19/2006/ND-CP dated February 20, 2006, detailing the Commercial Law regarding origin of goods;
In implementation of the Viet Nam - Korea Free Trade Agreement formally signed by the Government of the Socialist Republic of Viet Nam and the Government of the Republic of Korea on May 5, 2015 in Hanoi, Viet Nam;
At the proposal of the Director of the Import-Export Department;
The Minister of Industry and Trade promulgates the Circular providing for the implementation of rules of origin under the Viet Nam - Korea Free Trade Agreement.
Article 1. Viet Nam - Korea rules of origin
Issued together with this Circular are the following Appendices guiding the implementation of Chapter 3 on Rules of Origin and Origin Procedures under the Viet Nam - Korea Free Trade Agreement (hereinafter referred to as the VKFTA):
1. Rules of origin (Appendix I);
2. Product Specific Rules (Appendix II);
3. Guidance on the implementation of Article 6 of Appendix I (Appendix III);
4. Origin certification and verification procedures (Appendix IV);
5. Form of C/O VK issued by Viet Nam (Appendix V);
6. Form of C/O KV issued by Korea (Appendix VI);
7. Form of the supplementary C/O declaration sheet (Appendix VII);
8. Instructions for completing the C/O (Appendix VIII); and
9. List of C/O issuing bodies (Appendix IX).
Article 2. Procedures for the issuance and verification of C/O
The procedures for the issuance and verification of C/O shall comply with Appendix IV issued together with this Circular and Circular No. 06/2011/TT-BCT dated March 21, 2011 of the Ministry of Industry and Trade providing the procedures for issuing preferential Certificates of Origin (as amended and supplemented by Circular No. 01/2013/TT-BCT dated January 3, 2013 of the Ministry of Industry and Trade).
Article 3. Implementation provisions
This Circular takes effect from January 1, 2016./.
