The scope (volume) of protection is determined according to the content requested in the international registration of the mark as recorded by the International Bureau and accepted by the state management agency for industrial property rights.
3. For a mark for which part or all of the goods and services do not meet the protection conditions, or a mark meeting the protection conditions but whose international registration still has deficiencies (missing regulation on use of a collective mark or certification mark, missing photographs or drawings showing the perspective view of a three-dimensional mark, etc.), before the end of the 12-month period stated in Clause 1 of this Article, the state management agency for industrial property rights issues a notice of provisional refusal, clearly stating the content of and reasons for the intended refusal, and sends that notice to the International Bureau.
4. Within 03 months from the date the state management agency for industrial property rights sends the notice of provisional refusal for part or all of the goods and services, the applicant has the right to remedy the deficiencies or object to the intended refusal of the state management agency for industrial property rights.
Remedying deficiencies or objecting to the intended refusal is carried out under the same procedure as for a mark application filed under the national procedure, including the provisions on how to file the application.
5. Where the state management agency for industrial property rights intends to refuse part or all of the list of goods and services (stated in the notice of provisional refusal), if within the 03-month period stated in Clause 4 of this Article the applicant satisfactorily remedies the deficiencies and/or has well-founded objections to the intended refusal of that part or all of the goods and services, the state management agency for industrial property rights carries out the following procedures:
a) Issues a decision accepting protection of the internationally registered mark in Vietnam with a scope (volume) of protection corresponding to the goods and services meeting the protection conditions; records it in the National Register of Industrial Property (Part on Internationally Registered Marks); and sends the International Bureau a statement of protection after the notice of provisional refusal;
b) Publishes the decision in the Industrial Property Gazette within 02 months from the date of the decision.
6. Where the state management agency for industrial property rights intends to refuse part of the list of goods and services (stated in the notice of provisional refusal), if at the end of the 03-month period stated in Clause 4 of this Article the applicant has not remedied the deficiencies or has remedied them unsatisfactorily, has made no objection, or has made an objection that is not well-founded against that intended refusal, the state management agency for industrial property rights applies, mutatis mutandis, the procedures prescribed in Clause 5 of this Article solely to the goods and services meeting the protection conditions (goods and services not stated in the notice of provisional refusal).
7. Where the state management agency for industrial property rights intends to refuse the entire list of goods and services (stated in the notice of provisional refusal), if at the end of the 03-month period stated in Clause 4 of this Article the applicant has not remedied the deficiencies or has remedied them unsatisfactorily, has made no objection, or has made an objection that is not well-founded against the intended refusal of the entire list of goods and services, the state management agency for industrial property rights shall issue a decision refusing protection of the internationally registered mark in Vietnam and send the International Bureau a notice confirming total refusal.
8. Procedures for complaints and settlement of complaints against the decisions stated at Point a, Clause 2 and Clauses 5, 6 and 7 of this Article are carried out as for a mark application filed under the national procedure if there are grounds to believe that the decision was issued inconsistently with legal provisions on content and order of issuance. The result of settling the complaint is notified by the state management agency for industrial property rights to the applicant. Where, after the result of settling the complaint, part or all of the list of goods and services refused in the refusal decisions is accepted for protection, or there is a change in excluded elements (not protected separately), the state management agency for industrial property rights shall send the International Bureau the subsequent decision affecting the protection of the mark in the International Bureau's form on the corresponding contents.
9. From the date an international mark registration is accepted for protection in Vietnam, at the request of the mark owner, the state management agency for industrial property rights shall issue a certificate of protection in Vietnam of the internationally registered mark, provided that the requester pays the prescribed fees and charges.
10. From the date a Madrid application is published in the Gazette by the International Bureau until before the date of the decision accepting protection, or until the end of 12 months from the date the International Bureau notifies the application designating Vietnam, whichever is earlier, if a third party gives opinions on the Madrid application designating Vietnam, those opinions are regarded as a source of reference information in processing the application.
Article 28. Conversion of an international mark registration into an application filed under the national procedure
1. Where the international registration of a mark in Vietnam of a mark owner that is an individual or organisation of a member of the Madrid Protocol ceases to be valid under Article 6 of the Madrid Protocol, that person has the right to file a conversion application with the state management agency for industrial property rights to register protection for the same mark for part or all of the goods and services in the list recorded in the international mark registration but which ceased to be valid under Article 9quinquies of the Madrid Protocol. A converted mark application is accepted as valid if the following conditions are met:

dd) The applicant pays in full the prescribed fees and charges as for a mark application filed under the national procedure, except in the case prescribed at Point b, Clause 2 of this Article.
The converted mark application is recorded with a filing date being the international registration date or the date of subsequent designation (in the case of subsequent designation of Vietnam). Where the international registration enjoys a priority right under an international treaty, the converted mark application is recorded with the corresponding priority right, unless there are grounds for rejecting it.
2. The state management agency for industrial property rights examines the converted mark application under the conversion conditions stated in Clause 1 of this Article and according to the following principles:
a) For formal elements already accepted by the International Bureau in the corresponding international registration, the state management agency for industrial property rights does not re-examine them, except where the application has deficiencies (missing regulation on use of a collective mark or certification mark, missing photographs or drawings showing the perspective view of a three-dimensional mark, etc.). The state management agency for industrial property rights shall issue a decision refusing to accept the application where it does not meet the conditions prescribed in Clause 1 of this Article.
b) For a converted mark application from an international registration already accepted for protection in Vietnam, the state management agency for industrial property rights does not re-examine the substance. Where the application meets the conversion conditions prescribed in Clause 1 of this Article, the state management agency for industrial property rights carries out the procedures for notifying the intention to grant a protection title, deciding to grant the protection title, recording in the National Register of Industrial Property, and publishing the decision in the Industrial Property Gazette, as for an application filed under the national procedure.
c) For a valid converted mark application not falling under Point b of this Clause, the state management agency for industrial property rights carries out the procedures of accepting the application as valid, publishing the application, substantive examination and subsequent procedures, as for a mark application filed under the national procedure.
