AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULARS TO REDUCE AND SIMPLIFY ADMINISTRATIVE PROCEDURES IN THE FIELDS OF VEHICLE INSPECTION, CIVIL AVIATION, AND INSPECTORATE UNDER THE STATE MANAGEMENT OF THE MINISTRY OF CONSTRUCTION
Pursuant to the Law on Road Traffic Order and Safety No. 36/2024/QH15 dated June 27, 2024;
Pursuant to the Law on Inspection No. 84/2025/QH15 dated June 25, 2025;
Pursuant to the Law on Civil Aviation of Vietnam No. 66/2006/QH11 dated June 29, 2006; the Law Amending and Supplementing a Number of Articles of the Law on Civil Aviation of Vietnam No. 61/2014/QH13 dated November 21, 2014;
Pursuant to the Law on Product and Goods Quality No. 05/2007/QH12 dated November 21, 2007; the Law Amending and Supplementing a Number of Articles of the Law on Product and Goods Quality No. 35/2018/QH14 dated November 20, 2018; the Law Amending and Supplementing a Number of Articles of the Law on Product and Goods Quality No. 78/2025/QH15 dated June 18, 2025;

Pursuant to Decree No. 125/2015/NĐ-CP dated December 04, 2015 of the Government detailing flight operations management;
Pursuant to Decree No. 92/2016/NĐ-CP dated July 01, 2016 of the Government on conditional business lines in the civil aviation sector, as amended and supplemented by Decree No. 89/2019/NĐ-CP dated November 15, 2019 amending and supplementing a number of articles of Decree No. 92/2016/NĐ-CP dated July 01, 2016 of the Government on conditional business lines in the civil aviation sector and Decree No. 30/2013/NĐ-CP dated April 08, 2013 of the Government on air transport business and general aviation activities, and Decree No. 64/2022/NĐ-CP dated September 15, 2022 of the Government amending and supplementing a number of articles of the Decrees related to business activities in the civil aviation sector;
Pursuant to Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Construction;
At the proposal of the Director of the Vietnam Register, the Director of the Department of Legal Affairs, and the Director of the Civil Aviation Authority of Vietnam;
The Minister of Construction promulgates the Circular amending and supplementing a number of articles of Circulars to reduce and simplify administrative procedures in the fields of vehicle inspection, civil aviation and inspectorate under the state management of the Ministry of Construction.
Chapter I
AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 19/2017/TT-BGTVT DATED JUNE 06, 2017 OF THE MINISTER OF TRANSPORT PROVIDING FOR THE MANAGEMENT AND ASSURANCE OF FLIGHT OPERATIONS (AS AMENDED AND SUPPLEMENTED BY CIRCULAR NO. 32/2021/TT-BGTVT DATED DECEMBER 14, 2021, CIRCULAR NO. 28/2023/TT-BGTVT DATED SEPTEMBER 29, 2023, AND CIRCULAR NO. 15/2024/TT-BGTVT DATED MAY 29, 2024)
Article 1. Amending and supplementing Point e, Clause 1, and Clause 2 of Article 17, as amended and supplemented by Clause 6, Article 1 of Circular No. 32/2021/TT-BGTVT dated December 14, 2021, and Clause 1, Article 1 of Circular No. 15/2024/TT-BGTVT dated May 29, 2024
1. Point e, Clause 1 is amended and supplemented as follows:
“e) Aeronautical radio communication system operators;”
2. Clause 2 is amended and supplemented as follows:
“2. Air traffic controllers and aeronautical radio communication system operators must hold a valid licence and rating when performing their duties. Trainees undergoing on-the-job training (area control, approach control, aerodrome control) must be supervised and instructed by an air traffic controller or an air traffic instructor. The air traffic controller or air traffic instructor performing such supervision and instruction shall be responsible for the flight operation services provided by the trainee undergoing on-the-job training at that position.
The air navigation service provider is responsible for arranging sufficient air traffic personnel suited to their working positions.”
Article 2. Amending and supplementing Clause 2 of Article 50
“2. AIS personnel must be trained in accordance with regulations when performing their duties. The aeronautical information service provider must arrange sufficient AIS personnel who have been trained and are suited to their working positions.”
Article 3. Amending and supplementing Clause 2 of Article 103, as amended and supplemented by Point b, Clause 33, Article 1 of Circular No. 32/2021/TT-BGTVT dated December 14, 2021
“2. CNS personnel must be trained when performing their duties”
Article 4. Amending and supplementing Clause 2 of Article 114
“2. Aeronautical meteorological personnel must be trained in accordance with regulations when performing their duties. The aeronautical meteorological service provider must arrange sufficient meteorological personnel who have been trained and are suited to their working positions.”
Article 5. Amending and supplementing Clause 2 of Article 150
“2. Civil aviation search and rescue personnel must be trained when performing their duties.”
Article 6. Amending and supplementing Clause 2 of Article 174
“2. ATFM personnel must be trained in accordance with regulations when performing their duties. The air navigation service provider must arrange sufficient ATFM personnel who have been trained and are suited to their working positions.”.
Article 7. Amending and supplementing Clause 2 of Article 189
“2. Flight procedure design personnel must be trained when performing their duties.”.
Article 8. Amending and supplementing Clause 2 of Article 198
“2. Aeronautical chart, map and data personnel must be trained when performing their duties.”.
Article 9. Amending and supplementing Clause 1 of Article 271
“1. Flight inspection, calibration, and instrument flight procedure validation flight crew must be trained when performing their duties.”.
Article 10. Amending and supplementing Clause 2 of Article 333, as amended and supplemented by Clause 63, Article 1 of Circular No. 32/2021/TT-BGTVT dated December 14, 2021
“2. Within 08 days from the date of receipt of a complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall appraise, conduct an on-site inspection, request the applicant organization to provide additional explanation of relevant contents, and grant the ANS facility operating licence; where the licence is not granted, it must send a written reply to the applicant organization stating the reasons.
Where the dossier is incomplete, within 03 working days from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall guide the applicant organization to complete the dossier as prescribed.”.
Article 11. Amending and supplementing Clause 4 of Article 334, as amended and supplemented by Point c, Clause 64, Article 1 of Circular No. 32/2021/TT-BGTVT dated December 14, 2021
“4. For re-issuance under Points c and d, Clause 1 of this Article: within 06 days from the date of receipt of a complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall appraise, conduct an on-site inspection; request the applicant organization to provide additional explanation of relevant contents and re-issue the ANS facility operating licence; where the licence is not granted, it must send a written reply to the applicant organization stating the reasons.
Where the dossier is incomplete, within 03 working days from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall guide the applicant organization to complete the dossier as prescribed.”.
Article 12. Amending and supplementing Clause 2 of Article 337, as amended and supplemented by Clause 66, Article 1 of Circular No. 32/2021/TT-BGTVT dated December 14, 2021
“2. Within 06 days from the date of receipt of a complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall appraise, conduct an on-site inspection, request the applicant organization to provide additional explanation of relevant contents, and grant the operating licence for the technical systems and equipment ensuring flight operations; where the licence is refused, it must send a written reply to the applicant organization stating the reasons.
Where the dossier is incomplete, within 03 working days from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall guide the applicant organization to complete the dossier as prescribed.”.
Article 13. Amending and supplementing Clause 4 of Article 338, as amended and supplemented by Clause 67, Article 1 of Circular No. 32/2021/TT-BGTVT dated December 14, 2021
“4. For re-issuance under Points b, c and d, Clause 1 of this Article: within 06 days from the date of receipt of a complete dossier as prescribed, the Civil Aviation Authority of Vietnam shall appraise; request the applicant organization to provide additional explanation of relevant contents and re-issue the operating licence for the technical systems and equipment ensuring flight operations; where the licence is refused, it must send a written notice to the applicant stating the reasons.
Where the dossier is incomplete, within 03 working days from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall guide the applicant organization to complete the dossier as prescribed.”.
Article 14. Amending and supplementing a number of points and clauses of Article 339
1. Point e, Clause 1 is amended and supplemented
“e) Air traffic controllers and aeronautical radio communication system operators must attend and pass the examination for the grant of licences and ratings.
2. Point a, Clause 2 is amended and supplemented
“a) Air traffic controllers, aeronautical radio communication system operators, and air traffic instructors (applicable to training of these two categories of personnel) must have an English proficiency level of 4; ”.
3. Point g, Clause 4 is amended
“g) Being inspected and recognized by the Civil Aviation Authority of Vietnam. ”.
Article 15. Amending and supplementing Article 340, as amended and supplemented by Clause 69, Article 1 of Circular No. 32/2021/TT-BGTVT dated December 14, 2021
“1. A personnel licence is valid for 07 years from the date of signing. The validity period of personnel ratings is as follows:
a) 12 months for the following air traffic personnel ratings: aerodrome control; approach control without ATS surveillance; approach control with ATS surveillance; area control without ATS surveillance; area control with ATS surveillance;
b) 24 months for the aeronautical radio communication system operator rating.
2. Licences and ratings for flight operation safety assurance personnel apply to air traffic personnel with the following ratings:
a) Aerodrome control;
b) Approach control without ATS surveillance;
c) Approach control with ATS surveillance;
d) Area control without ATS surveillance;
đ) Area control with ATS surveillance;
e) Aeronautical radio communication system operators."
Article 16. Amending and supplementing Point b, Clause 1, and Clause 2 of Article 341, as amended and supplemented by Clause 70, Article 1 of Circular No. 32/2021/TT-BGTVT dated December 14, 2021
1. Point b, Clause 1 is amended and supplemented
“b) A copy of the relevant diploma or training certificate;”.
2. Clause 2 is amended and supplemented
“2. Within 11 days from the date of receipt of a complete dossier, the Civil Aviation Authority of Vietnam shall appraise the dossier, organize an examination, and grant the licence and rating to flight operation safety assurance personnel using Form No. 03 provided in Appendix IX issued with this Circular; where the licence or rating is not granted, it must send a written reply to the applicant organization stating the reasons.
Where the dossier is incomplete, within 05 working days from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall guide the applicant organization to complete the dossier as prescribed.”.
Article 17. Amending and supplementing Clause 4 of Article 342, as amended and supplemented by Clause 71, Article 1 of Circular No. 32/2021/TT-BGTVT dated December 14, 2021
“4. For a licence or rating re-issued due to expiry of the licence or rating: within 10 days from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall appraise the dossier, organize an examination, and re-issue the licence and rating to flight operation safety assurance personnel; where it is not re-issued, it must send a written reply to the applicant organization stating the reasons.
Where the dossier is incomplete, within 03 working days from the date of receipt of the dossier, the Civil Aviation Authority of Vietnam shall guide the applicant enterprise to complete the dossier as prescribed.”.
Article 18. Replacing Form No. 05 of Appendix VIII issued with Circular No. 19/2017/TT-BGTVT dated June 06, 2017, which was replaced by Article 2 of Circular No. 28/2023/TT-BGTVT dated September 28, 2023, with the corresponding application form in Appendix I issued with this Circular.
Article 19. Repealing Appendix XI issued with Circular No. 19/2017/TT-BGTVT dated June 06, 2017, which was replaced by Clause 4, Article 2 of Circular No. 32/2021/TT-BGTVT dated December 14, 2021.

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 10/2018/TT-BGTVT DATED MARCH 14, 2018 OF THE MINISTER OF TRANSPORT PROVIDING FOR AVIATION PERSONNEL; TRAINING AND EXAMINATION OF AVIATION PERSONNEL (AS AMENDED AND SUPPLEMENTED BY CIRCULAR NO. 35/2021/TT-BGTVT DATED DECEMBER 17, 2021, AND CIRCULAR NO. 01/2025/TT-BXD DATED MARCH 28, 2025)
Article 20. Amending and supplementing Clauses 3 and 4 of Article 4
1. Clause 3 is amended and supplemented as follows:
“3. The rating and on-the-job training program is a training program for aviation personnel who have been granted a professional certificate to sit the rating examination and perform duties at the appropriate working position in accordance with regulations in the relevant specialized field.”.
2. Clause 4 is amended and supplemented as follows:
“4. The periodic (recurrent) training program is a training program that reviews previously learned knowledge and supplements new updated knowledge in the aviation specialty so that aviation personnel maintain their capability to work in their professional position.”
Article 21. Amending and supplementing Point c, Clause 3, and repealing Point d, Clause 3, of Article 8
1. Point c, Clause 3 is amended and supplemented as follows:
“c) Aviation personnel referred to in Clauses 14, 15 and 16 of Article 6 of this Circular must hold the aviation specialized professional certificate provided in Clause 1, Article 9 of this Circular and must be trained through periodic and refresher training as prescribed.”.
2. Point d, Clause 3 is repealed.
Article 22. Amending and supplementing Clause 3 of Article 10
“3. Holders of the aviation personnel titles referred to in Clauses 1, 2, 4, 5 and 6, Article 6 (applicable to the ratings of air traffic controller and aeronautical radio communication system operator), and Clause 13, Article 6 of this Circular must carry a valid aviation personnel licence when performing their duties.”.
Article 23. Amending, supplementing and repealing a number of items of Appendix 03 issued with Circular No. 10/2018/TT-BGTVT dated March 14, 2018, which was replaced by Clause 1, Article 2 of Circular No. 35/2021/TT-BGTVT dated December 17, 2021
1. Item II is amended and supplemented as follows:
“II. Licences and ratings for aviation personnel in the flight operation safety assurance group
Air traffic personnel licence with the following ratings:
a) Aerodrome control;
b) Approach control without ATS surveillance;
c) Approach control with ATS surveillance;
d) Area control without ATS surveillance;
đ) Area control with ATS surveillance;
e) Aeronautical radio communication system operators.".
2. Item III of Appendix 03 is repealed.
Article 24. Amending and supplementing Appendix 04 issued with Circular No. 10/2018/TT-BGTVT dated March 14, 2018, which was replaced by Clause 2, Article 2 of Circular No. 35/2021/TT-BGTVT dated December 17, 2021

Trainees are personnel designated by units operating at airports and aerodromes to attend periodic refresher training courses for aviation personnel in the airport/aerodrome operation group who already hold a professional certificate and have worked continuously for no more than 36 months in the relevant position.”
2. Clause 2, Chapter II, Part B is amended and supplemented as follows:
“2. Subjects
Trainees are personnel designated by units operating at airports and aerodromes to attend periodic refresher training courses for aviation personnel in the airport/aerodrome operation group who already hold a professional certificate and have worked continuously for no more than 36 months in the relevant position.”
3. Clause 2, Chapter I, Part C is amended and supplemented as follows:
“2. Subjects
Trainees are personnel designated by units operating at airports and aerodromes to attend recurrency (refresher) training courses for aviation personnel in the airport/aerodrome operation group who already hold a professional certificate but have had a break of 03 months or more, for personnel operating aviation equipment or vehicles in restricted areas of airports/aerodromes and airport/aerodrome rescue and firefighting personnel, or 06 months or more for ground handling personnel serving flights.”
4. Clause 2, Chapter II, Part C is amended and supplemented as follows:
“2. Subjects

“1. Objective: To equip trainees with general knowledge of civil aviation, professional specialized knowledge and basic skills in the field of flight operation assurance. Upon completion of the course, trainees are granted a professional certificate and may attend training at the appropriate professional working positions.”.
b) Item 6 of Section I, Clause 4 is amended as follows:
“6. Flight data processing personnel (for those currently working at an AFTN position).”.
2. Part B is amended and supplemented
a) The name of Part B is amended as follows:
“B. RATING AND ON-THE-JOB TRAINING PROGRAM”
b) Clause 1 is amended as follows:
“1. Objective: To equip trainees with the necessary professional knowledge and skills and provide practical training at the assigned working position. Upon completion of the course, trainees are qualified to sit the examination for the grant of a licence or rating, or to work at the appropriate professional working positions as prescribed in the legal instruments on flight operation management and assurance.”
c) Clause 2 is amended as follows:
“2. Subjects: Trainees who have been granted a professional certificate suited to the rating position and working position at a Vietnamese or foreign aviation personnel training institution licensed or recognized by the Civil Aviation Authority of Vietnam”.
d) Item 12 of Section I, Clause 4 is amended as follows:
“12. Aeronautical radio communication system operators”.
3. Part C is amended and supplemented
a) The name of Part C is amended as follows:

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 01/2011/TT-BGTVT DATED JANUARY 27, 2021 OF THE MINISTER OF TRANSPORT PROMULGATING THE CIVIL AVIATION SAFETY REGULATIONS FOR AIRCRAFT AND AIRCRAFT OPERATIONS AND THE CIRCULARS AMENDING AND SUPPLEMENTING CIRCULAR NO. 01/2011/TT-BGTVT DATED JANUARY 27, 2021 OF THE MINISTER OF TRANSPORT
Article 27. Amending and supplementing Item 1, Point d, Appendix 1 of Article 9.157 prescribed in Part 9, as amended and supplemented under Item 1, Appendix VI amending and supplementing a number of articles of Part 9 of the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations issued with Circular No. 56/2018/TT-BGTVT dated December 11, 2018
“(1) Where the dossier is accepted, within the following 10 days, the CAAV shall consider formulating a plan and conduct an inspection at the location of the flight simulation training device.”.
Article 28. Amending Points a and b of Article 21.071 prescribed in Part 21, as amended and supplemented under Item 4, Appendix XII amending and supplementing a number of articles of Part 21 of the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations issued with Circular No. 56/2018/TT-BGTVT dated December 11, 2018
1. Point a is amended and supplemented as follows:
“a) Within 4 months from receipt of the application for a Type Certificate, the CAAV shall carry out the necessary inspections and tests to grant a Type Certificate for the type of aircraft, engine and propeller designed and manufactured in Vietnam, including:”
2. Point b is amended and supplemented as follows:
“b) Within 4 months from receipt of the application for recognition of a Type Certificate, the CAAV shall carry out the necessary inspections and tests to recognize the Type Certificate for the type of aircraft, engine and propeller first operated in Vietnam, including:”.
Article 29. Amending and supplementing Points c, d and e of Article 12.013 prescribed in Part 12, as amended and supplemented under Point a, Item 1, Appendix VIII amending and supplementing a number of articles of Part 12 of the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations issued with Circular No. 56/2018/TT-BGTVT dated December 11, 2018
1. Point c is amended and supplemented as follows:
“c) Within 10 days from receipt of the Operator's dossier, the CAAV shall appraise the validity and completeness of the AOC application dossier and notify the applicant of the appraisal result. Where the AOC application dossier is invalid or incomplete, the applicant must supplement it, and the AOC approval time shall only be counted from the date the dossier is supplemented as required.”
2. Point d is amended and supplemented as follows:
“d) Within 10 days from the date of notification of the validity and completeness of the AOC application dossier, the CAAV shall review the content of the documents and coordinate with the Aircraft Operator to develop an on-site inspection plan.”.
3. Point e is amended and supplemented as follows:
“e) Within 25 days from the time the on-site inspection plan is agreed, the CAAV shall carry out the inspection; if the inspection result shows that the applicant fully satisfies the requirements of this Part, the CAAV shall grant the Air Operator Certificate. Where the requirements are not yet satisfied, the CAAV shall notify the applicant of the result and agree on a time limit for rectifying the unmet requirements. The time needed to rectify the unmet requirements shall be added to the AOC approval time.”.
Article 30. Amending and supplementing Points g, h and i of Article 12.023 prescribed in Part 12
1. Point g is amended and supplemented as follows:
“(g) Within 5 working days from receipt of the Operator's application for AOC renewal or amendment, the CAAV shall appraise the validity and completeness of the dossier and notify the applicant of the appraisal result. Where the dossier is invalid or incomplete, the applicant must supplement it, and the AOC renewal/amendment time shall only be counted from the date the dossier is supplemented as required.”.
2. Point h is amended and supplemented as follows:
“(h) Within 3 working days from the time a complete dossier is received, the CAAV shall review the content of the documents and coordinate with the Aircraft Operator to develop an on-site inspection plan for AOC renewal or amendment.”.
3. Point i is amended and supplemented as follows:
“(i) Within 15 days from the time the on-site inspection plan is agreed, the CAAV shall carry out the inspection; if the inspection result shows that the applicant fully satisfies the requirements of this Part, the CAAV shall grant the AOC renewal or amendment. Where specific requirements are not yet satisfied, the CAAV shall notify the applicant of the result and agree on a time limit for rectifying the unmet requirements. The time needed to rectify the unmet requirements shall be added to the AOC renewal or amendment time.”.
Article 31. Amending and supplementing Point g, Appendix 1 of Article 7.350 prescribed in Part 7, as amended and supplemented under Item 3, Appendix II amending and supplementing a number of articles of Part 7 of the Civil Aviation Safety Regulations for Aircraft and Aircraft Operations issued with Circular No. 11/2022/TT-BGTVT dated June 29, 2022
“(g) Within 06 days from the time a complete dossier is received, the Civil Aviation Authority of Vietnam shall be responsible for appraising the dossier, organizing an inspection, and re-issuing or renewing the appropriate rating.”
Chapter IV
AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 29/2021/TT-BGTVT DATED NOVEMBER 30, 2021 OF THE MINISTER OF TRANSPORT DETAILING THE MANAGEMENT AND OPERATION OF AIRPORTS AND AERODROMES
Article 32. Amending and supplementing Clause 9 of Article 30
“9. Where a person operating a vehicle in the restricted area of an airport or aerodrome does not hold a professional certificate for operating vehicles or equipment in the restricted area of the airport/aerodrome, and has not undergone periodic or refresher training as prescribed, such vehicle must be guided by a vehicle of the airport/aerodrome operator, except where construction vehicles have determined their route of movement under a plan approved by the competent authority.”.
Article 33. Amending and supplementing Clause 8 of Article 51
“8. The operation of aircraft fluid-servicing equipment shall be carried out by technical personnel holding a professional certificate who have undergone periodic or refresher training as prescribed, in accordance with the operating manual.”
Article 34. Repealing a number of provisions, including:
1. Article 82 is repealed.
2. Form No. 04 (4.1 and 4.2) of Appendix I and Appendix III issued with Circular No. 29/2021/TT-BGTVT are repealed.

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 46/2024/TT-BGTVT DATED NOVEMBER 15, 2024 OF THE MINISTER OF TRANSPORT PROVIDING FOR THE ORDER AND PROCEDURES FOR THE NEW ISSUANCE, RE-ISSUANCE, TEMPORARY SUSPENSION AND REVOCATION OF CERTIFICATES OF ELIGIBILITY FOR MOTOR VEHICLE INSPECTION OPERATIONS OF MOTOR VEHICLE INSPECTION CENTERS AND MOTORCYCLE/MOPED EMISSION TESTING FACILITIES
Article 36. Amending and supplementing Clauses 3 and 5 of Article 4
1. Clause 3 is amended and supplemented as follows:
“3. On-site inspection and assessment
The on-site inspection and assessment shall be carried out within 10 days from the date the dossier receipt notice is made, specifically as follows:
a) The Department of Construction shall inspect and assess the conditions for conducting the motor vehicle inspection service business of the motor vehicle inspection center in accordance with the Decree on conditions for conducting the motor vehicle inspection service business; the organization and operation of inspection centers; and the service life of motor vehicles, and prepare minutes using the form provided in Appendix VII issued with this Circular;
b) The Department of Construction shall request the Vietnam Register to participate in inspecting and assessing the motor vehicle inspection center against the technical requirements provided in the national technical regulation on physical and technical facilities and the location of motor vehicle inspection centers and motorcycle/moped emission testing facilities. The content of the inspection and assessment shall be recorded in minutes using Form No. 01 provided in Appendix VIII and the minutes using the forms provided in Appendix IX issued with this Circular. Where a conformity assessment organization is engaged, the inspection and assessment under this point shall be replaced by the assessment and certification result of the conformity assessment organization certifying that the motor vehicle inspection center conforms to the national technical regulation on physical and technical facilities and the location of motor vehicle inspection centers and motorcycle/moped emission testing facilities;
c) Consolidate the results and record the corresponding contents in Form No. 01 provided in Appendix X issued with this Circular.”
2. Clause 5 is amended and supplemented as follows:
“5. Grant of the certificate of eligibility for motor vehicle inspection operations
Within 03 working days from the date the on-site inspection and assessment is completed with a satisfactory result, the Department of Construction shall grant the certificate of eligibility for motor vehicle inspection operations using Form No. 01 provided in Appendix XI; and the inspection center code as provided in Appendix XII issued with this Circular.”
Article 37. Amending and supplementing Clause 3 of Article 5
“3. Re-issuance of the certificate of eligibility for motor vehicle inspection operations for the cases specified at Points a, b and c, Clause 2 of this Article:
a) Where the dossier is submitted directly: the Department of Construction shall check the composition of the dossier on the same working day; if incomplete as prescribed, it shall guide the motor vehicle inspection center to complete the dossier; if complete as prescribed, within 03 working days from the date of receipt of the application, based on the dossier on file, the Department of Construction shall re-issue the certificate of eligibility for motor vehicle inspection operations;
b) Where the dossier is submitted by post or through the online public service system: within 01 working day from the time the dossier is received, the Department of Construction shall check the composition of the dossier; if incomplete as prescribed, it shall notify the motor vehicle inspection center using the form provided in Appendix VI issued with this Circular; if complete as prescribed, within 03 working days from the date of receipt of the application, based on the dossier on file, the Department of Construction shall re-issue the certificate of eligibility for motor vehicle inspection operations.”
Article 38. Amending and supplementing Clauses 3 and 5 of Article 10
1. Clause 3 is amended and supplemented as follows:
“3. On-site inspection and assessment
The on-site inspection and assessment shall be carried out within 10 days from the date the dossier receipt notice is made, as follows:
a) Inspect and assess the emission testing facility's conformity with the technical requirements provided in the national technical regulation on physical and technical facilities and the location of motor vehicle inspection centers and motorcycle/moped emission testing facilities, and record the result in minutes using Form No. 02 provided in Appendix VIII issued with this Circular;
b) Inspect and assess the emission testing facility in accordance with the Decree on conditions for conducting the motor vehicle inspection service business; the organization and operation of inspection centers; the service life of motor vehicles; and consolidate the inspection and assessment result under Point a of this Clause, recording the corresponding contents in minutes using Form No. 02 provided in Appendix X issued with this Circular.”
2. Clause 5 is amended and supplemented as follows:
“5. Grant of the certificate of eligibility for motorcycle/moped emission testing operations
Within 03 working days from the date the on-site inspection and assessment is completed with a satisfactory result, the Department of Construction shall grant the certificate of eligibility for motorcycle/moped emission testing operations using Form No. 02 provided in Appendix XI; and the emission testing facility code as provided in Appendix XII issued with this Circular.”
Article 39. Amending and supplementing Clause 3 of Article 11
“3. Re-issuance of the certificate of eligibility for motorcycle/moped emission testing operations for the cases specified at Points a, b and c, Clause 2 of this Article:
a) Where the dossier is submitted directly: the Department of Construction shall check the composition of the dossier on the same working day; if incomplete as prescribed, it shall guide the emission testing facility to complete the dossier; if complete as prescribed, within 03 working days from the date of receipt of the application, based on the dossier on file, the Department of Construction shall re-issue the certificate of eligibility for motorcycle/moped emission testing operations;
b) Where the dossier is submitted by post or through the online public service system: within 01 working day from the time the dossier is received, the Department of Construction shall check the composition of the dossier; if incomplete as prescribed, it shall prepare a notice using the form provided in Appendix VI issued with this Circular to the emission testing facility; if complete as prescribed, within 03 working days from the date of receipt of the application, based on the dossier on file, the Department of Construction shall re-issue the certificate of eligibility for motorcycle/moped emission testing operations.”.

Where the vehicle has only a receipt for the vehicle registration certificate, the inspection center shall issue the inspection sticker and a receipt for the return of the inspection certificate to the vehicle owner using Form No. 01 provided in Appendix VI issued with this Circular, and shall only issue the inspection certificate after the vehicle owner is granted vehicle registration or presents the vehicle registration documents”

Vehicles manufactured or assembled domestically, and vehicles subject to research and development, wishing to participate in road traffic: in case of force majeure as prescribed by law where vehicle registration data from the vehicle registration authority cannot yet be shared, the vehicle owner must present the original temporary vehicle registration certificate or the temporary vehicle registration certificate integrated into a level-2 or higher electronic identification account, and submit a copy of the ex-factory quality inspection slip.”
2. Point a, Clause 2, Article 9 is amended and supplemented as follows:
“a) In case of force majeure as prescribed by law where vehicle registration data from the vehicle registration authority cannot yet be shared, the vehicle owner must present the original temporary vehicle registration certificate or the temporary vehicle registration certificate integrated into a level-2 or higher electronic identification account;”
3. Clause 3, Article 9 is amended and supplemented as follows
“3. Imported vehicles (other than those specified in Clauses 1 and 2 of this Article): in case of force majeure as prescribed by law where vehicle registration data from the vehicle registration authority cannot yet be shared, the vehicle owner must present the original temporary vehicle registration certificate or the temporary vehicle registration certificate integrated into a level-2 or higher electronic identification account, and submit a copy of the foreign manufacturer's ex-factory quality inspection slip.”
Article 46. Amending and supplementing Point b, Clause 5, and Point b, Clause 6, Article 11
1. Point b, Clause 5 is amended and supplemented as follows:
“ b) Where the motor vehicle passes inspection: the inspection center shall issue the inspection certificate and affix the inspection sticker as prescribed in Article 17 of this Circular; and shall remove any prior failed-inspection warning immediately after completion of the inspection and assessment.
Where the vehicle has only a receipt for the vehicle registration certificate, the inspection center shall issue the inspection sticker and a receipt for the return of the inspection certificate to the vehicle owner using Form No. 01 provided in Appendix VI issued with this Circular, and shall only issue the inspection certificate within 04 working hours from when the vehicle owner presents the vehicle registration documents or vehicle registration data is shared by the vehicle registration authority”
2. Point b, Clause 6 is amended and supplemented as follows:
“b) Where the motor vehicle passes inspection: within 03 working days from completion of the inspection, the inspection center shall issue the inspection certificate and inspection sticker as prescribed in Article 17 of this Circular and send them to the vehicle owner; and shall remove any prior failed-inspection warning immediately after completion of the inspection and assessment.
Where the vehicle has only a receipt for the vehicle registration certificate, the inspection center shall issue the inspection sticker and a receipt for the return of the inspection certificate to the vehicle owner using Form No. 01 provided in Appendix VI issued with this Circular, and shall only issue the inspection certificate within 04 working hours from when the vehicle owner presents the vehicle registration documents or vehicle registration data is shared by the vehicle registration authority”.
Article 47. Amending and supplementing Point b, Clause 4, and Point b, Clause 6, Article 12
1. Point b, Clause 4 is amended and supplemented as follows:
“b) Where the specialized mobile machinery passes inspection: the inspection center shall issue the inspection certificate and affix the inspection sticker as prescribed in Article 17 of this Circular; and shall remove any prior failed-inspection warning immediately after completion of the inspection and assessment.

Article 48. Amending and supplementing Clause 1 of Article 15
“1. Where the inspection certificate or inspection sticker contains incorrect information, the inspection center shall re-issue the inspection certificate and inspection sticker within 04 working hours from receipt of the dossier, while also collecting the incorrect inspection certificate and inspection sticker;”.
Article 49. Amending and supplementing Point a, Clause 2, Article 21

Article 51. Amending and supplementing Clause 2 and Point a, Clause 3, Article 23
1. Clause 2 is amended and supplemented as follows:
“2. Inspection and assessment of the modification design dossier
Within 03 working days from the date of receipt of the dossier (except for the cases specified in Clause 5, Article 20 of this Circular), the inspection center shall proceed as follows:
a) Where the content of the modification design dossier satisfies the requirements provided in Appendix XIV issued with this Circular, and the design content conforms to the technical regulations on technical safety quality and environmental protection for motor vehicles, specialized mobile machinery and motor vehicle parts, the inspection center shall prepare a notice using the form provided in Appendix I issued with this Circular, sending it to the vehicle owner with information on the time and place of the on-site inspection and assessment of the modified vehicle;
b) Where the content of the modification design dossier does not fully satisfy the requirements provided in Appendix XIV issued with this Circular, or contains content that does not conform to the technical regulations on technical safety quality and environmental protection for motor vehicles, specialized mobile machinery and motor vehicle parts, the inspection center shall prepare a notice using the form provided in Appendix I issued with this Circular, sending it to the vehicle owner clearly stating the content requiring supplementation or amendment. Within 30 days from the date of the notice, the vehicle owner is responsible for supplementing and completing the modification design dossier; upon receipt of the supplemented or amended design dossier, the inspection center shall inspect and assess the modification design dossier as provided in Point a of this Clause; if the above time limit expires, the certification procedure shall be carried out again from the beginning.”.
2. Point a, Clause 3 is amended and supplemented as follows:
“ a) For a modified vehicle requiring a modification design dossier: within 03 days from the date of notification of the on-site inspection and assessment of the vehicle, the inspection center shall inspect and assess the modified vehicle against the technical requirements provided in the National Technical Regulation on motor vehicle inspection and specialized mobile machinery inspection; inspect and assess the modified items of the vehicle against the National Technical Regulation on technical safety quality and environmental protection of motor vehicles and specialized mobile machinery, and the National Technical Regulation on permissible tolerances and rounding for dimensions and mass; and prepare an inspection and assessment record using Form No. 02 provided in Appendix XV issued with this Circular.”
Article 52. Amending and supplementing Clause 4 of Article 24
“4. Order and procedures for re-issuance of the modification certificate
The inspection center shall re-issue the modification certificate using the form provided in Appendix XVIII issued with this Circular within 01 working day from the time the dossier is received, for cases where the dossier is on file at the inspection center; or within 02 working days from the time the dossier is received, for cases where the dossier is on file at another inspection center, specifically as follows:
a) Re-issuance for a lost or damaged modification certificate: based on the data stored on the vehicle modification management software and the modification dossier on file, re-issuance shall be carried out;
b) Re-issuance for a modification certificate containing incorrect information: based on the data stored on the vehicle modification management software and the modification dossier on file, where there is sufficient basis to determine that the issued modification certificate contains incorrect information, the information shall be corrected and the modification certificate re-issued.”.
Article 53. Amending and supplementing Clause 2 of Article 27
“2. For motorcycles and mopeds whose time from the year of manufacture exceeds 05 years, the vehicle owner must bring the vehicle to an inspection center for emission testing.
In case of force majeure as prescribed by law where vehicle registration data from the vehicle registration authority cannot yet be shared, the vehicle owner shall present one of the vehicle registration documents or the original receipt for the vehicle registration certificate. The inspection center shall receive the dossier, look up information on the motorcycle/moped in the inspection management software, and cross-check the vehicle registration certificate against the actual motorcycle/moped: where the vehicle is subject to refusal of inspection, the inspection center shall prepare a notice using the form provided in Appendix I issued with this Circular, sending it to the vehicle owner; where the vehicle is not subject to refusal of inspection, an inspection control slip shall be prepared using Form No. 3 of Appendix IV issued with this Circular.
a) Where the dossier is submitted directly: the inspection center shall carry out the emission test immediately, within 04 working hours from receipt of a complete dossier. The inspection and assessment of motorcycle/moped emissions must be carried out in accordance with the National Technical Regulation on technical safety and environmental protection inspection of motor vehicles; if the inspection result does not meet the requirements, the inspection center shall prepare a notice using the form provided in Appendix I issued with this Circular, sending it to the vehicle owner; where the result meets the requirements, the inspection center shall issue an emission inspection certificate with a validity period as provided in Appendix V issued with this Circular.
b) Where the dossier is submitted through the online system: the inspection center shall confirm the emission testing appointment and notify the vehicle owner of the time for conducting the motorcycle/moped emission test. When the vehicle owner brings the motorcycle/moped, the inspection center shall proceed as provided in Point a of this Clause.”

Chapter VIII
AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 54/2024/TT-BGTVT DATED NOVEMBER 15, 2024 OF THE MINISTER OF TRANSPORT PROVIDING FOR THE ORDER AND PROCEDURES FOR CERTIFICATION OF TECHNICAL SAFETY QUALITY AND ENVIRONMENTAL PROTECTION OF IMPORTED MOTOR VEHICLES, SPECIALIZED MOBILE MACHINERY AND MOTOR VEHICLE PARTS
Article 55. Repealing Point h, Clause 1, Article 5
Article 56. Amending and supplementing Clause 4 of Article 9
“4. Issuance of Quality Certificates
Within 03 working days from the date the dossier is assessed as complete and valid as prescribed, the certifying authority shall issue an electronic Quality Certificate on the National Single Window Portal, or a paper certificate (at the written request of the applicant, or in force majeure cases where issuance via the National Single Window Portal is not possible) for each type of part in the registration dossier, specifically as follows:
a) Issue a certificate for the imported type of part where the dossier fully contains the documents specified in Clause 1, Article 10 of this Circular and the part test report is satisfactory;
b) Issue a certificate for an imported shipment of parts where the inspection registration dossier contains the documents specified at Points a, b, d, đ and e, Clause 1, Article 10 of this Circular and the part test report is satisfactory;
c) Issue a notice of non-conformity in the following cases: the part test report is not satisfactory; the dossier is not fully supplemented within 45 days from the date of customs clearance or provisional release of the goods for storage (except in force majeure cases, or where sample testing or quality assurance assessment of the manufacturing plant is being conducted);
d) Issue a notice of violation for imported parts falling under any of the following cases: the imported part is on the list of goods banned from import under Decree No. 69/2018/NĐ-CP; the documents in the inspection registration dossier or the imported part contain images or content that misrepresent national sovereignty, or contain other content affecting Vietnam's security, politics, economy, society or foreign relations; or other cases subject to the administrative penalty of confiscation of goods under the law on imported goods.”.
Article 57. Amending and supplementing Clause 3 and Point b, Clause 4, Article 13
1. Clause 3 is amended and supplemented as follows:
“3. Replacement of a damaged Quality Certificate
Within a maximum of 01 working day from the date of receipt of the application, the certifying authority shall receive and check the composition of the dossier: where the dossier is incomplete, it shall guide the importer to complete the dossier as prescribed; where the dossier is complete, it shall inspect, assess and issue the quality certificate.
Within 02 working days from the date of receipt of a complete dossier as prescribed in Clause 2 of this Article, the certifying authority shall proceed as follows:
a) Issue a replacement original Quality Certificate where the dossier is complete as prescribed. Upon receiving the Quality Certificate, the importer must return the original damaged Quality Certificate;
b) Where the replacement is not granted, the certifying authority shall send a written reply stating the reasons.”.
2. Point b, Clause 4 is amended and supplemented as follows:
“b) Within 03 working days from the date of receipt of a complete dossier as prescribed in Clause 2 of this Article, the certifying authority shall send a written notice to the importer and to the customs, tax and police authorities; where the dossier is incomplete, the certifying authority shall guide the importer to complete the dossier.”.
Chapter IX
AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF CIRCULAR NO. 55/2024/TT-BGTVT DATED NOVEMBER 15, 2024 OF THE MINISTER OF TRANSPORT PROVIDING FOR THE ORDER AND PROCEDURES FOR CERTIFICATION OF TECHNICAL SAFETY QUALITY AND ENVIRONMENTAL PROTECTION OF DOMESTICALLY MANUFACTURED AND ASSEMBLED MOTOR VEHICLES, SPECIALIZED MOBILE MACHINERY AND MOTOR VEHICLE PARTS
Article 58. Amending and supplementing Clause 4 of Article 7
“4. The certifying authority shall issue the product type certification within 02 working days from the date of the satisfactory COP assessment result and the satisfactory dossier examination result. The Certificate of Technical Safety Quality and Environmental Protection for the product type (hereinafter referred to as the “Product Type Certificate”) is valid for 36 months from the date of issuance. The issuance of the product type certification is provided as follows:
a) The Certificate of Technical Safety and Environmental Protection for the vehicle type (Vehicle Type Certificate) using the form provided in Appendix IX issued with this Circular; and the blank Ex-factory Quality Inspection Slip using the form provided in Appendix VII issued with this Circular;
b) The Certificate of Technical Safety and Environmental Protection for the part type (Part Type Certificate) using the form provided in Appendix X issued with this Circular.”.
Article 59. Amending and supplementing Point d, Clause 3, Article 8
“d) The certifying authority shall issue the Certificate within 02 working days from the date of the satisfactory COP assessment result and the satisfactory dossier examination result. The Certificate shall be issued using the form provided in Appendix IX or Appendix X issued with this Circular. The validity period of a Certificate re-issued due to expiry is 36 months from the date of issuance. The validity period of a Certificate re-issued due to a change in the applicable national technical regulation is 36 months from the date of issuance if the inspection and testing are carried out under the entirety of the national technical regulations applicable to the product type. The validity period of a Certificate re-issued in other cases shall follow the validity period of the previously issued Certificate;”.
Article 60. Amending and supplementing Point d, Clause 3, Article 9
“d) The certifying authority shall issue the extended Certificate within 02 working days from the date of the satisfactory COP assessment result and satisfactory dossier content. The Certificate shall be issued using the form provided in Appendix IX or Appendix X issued with this Circular. The validity period of the extended Certificate shall follow the validity period of the Certificate for the product type prior to the change;”.
Article 61. Amending and supplementing Point c, Clause 4, Article 10
“c) The certifying authority shall inspect the COP assessment result and examine the dossier content within 06 working days from the date the dossier is received and the manufacturing facility has paid all applicable service charges and fees in full.
If the COP result and the dossier examination result are satisfactory, the certifying authority shall record and supplement the changed content for the certified product type and notify the manufacturing facility in writing or through the online public service system.
If the dossier content is not conforming or the COP result is not satisfactory, the certifying authority shall notify the manufacturing facility to supplement and complete it; where the COP result is not satisfactory, the manufacturing facility shall agree with the certifying authority on a time for the COP assessment to be conducted. The manufacturing facility is responsible for completing the non-conforming dossier content as notified and resubmitting it to the certifying authority. The processing time shall be recalculated from the beginning upon receipt of the complete dossier as supplemented and completed by the manufacturing facility.
The manufacturing facility is permitted to supplement and complete non-conforming content within a maximum period of 03 months from the date of the first notification. After the 03-month period expires, the certifying authority shall stop the dossier examination and COP assessment and notify, in writing or through the online public service system, that it will not record or supplement the changed content for the certified product type.”.

Article 64. Amending and supplementing Article 8
“Article 8. Process for using professional technical means and equipment
1. Professional technical means and equipment may only be installed and used upon a decision or plan approved by the competent person.
2. Based on the approved inspection/examination plan, the unit managing the use of professional technical means and equipment shall prepare a plan for the use of the necessary and appropriate technical means and equipment. The plan must clearly state: the time, place and purpose of use; the user; and the name of the professional technical means and equipment.
3. The process and operation for using and preserving professional technical means and equipment shall be carried out in accordance with the manufacturer's instructions and the applicable technical regulation (if any).
4. Professional technical means and equipment must be handed over and received according to the work plan; the handover and receipt shall be recorded in the handover/receipt logbook for professional technical means and equipment.
5. The plan for using professional technical means and equipment prescribed herein may be formulated and approved within the inspection/examination plan of the unit.

This Circular takes effect from December 31, 2025
Article 66. Transitional provisions
For imported goods not on the list of products and goods specified in Appendix II and Appendix III issued with this Circular, but on the list of products and goods specified in Appendix I and Appendix II issued with Circular No. 62/2024/TT-BGTVT, for which a quality inspection registration for technical safety and environmental protection was issued before the effective date of this Circular, the certification procedure for technical safety quality and environmental protection shall continue to be completed in accordance with the regulations applicable at the time such quality inspection registration was issued.
