CIRCULAR PROVIDING THE LIST OF PRODUCTS AND GOODS WITH POTENTIAL SAFETY RISKS UNDER THE STATE MANAGEMENT RESPONSIBILITY OF THE MINISTRY OF LABOUR, WAR INVALIDS AND SOCIAL AFFAIRS
Pursuant to the Law on Product and Goods Quality dated November 21, 2007;
Pursuant to the Government's Decree No. 132/2008/NĐ-CP dated December 31, 2008, detailing the implementation of a number of articles of the Law on Product and Goods Quality;
Pursuant to the Government's Decree No. 74/2018/NĐ-CP dated May 15, 2018, amending and supplementing a number of articles of the Government's Decree No. 132/2008/NĐ-CP dated December 31, 2018, detailing the implementation of a number of articles of the Law on Product and Goods Quality;
Pursuant to the Government's Decree No. 154/2018/NĐ-CP dated November 9, 2018, amending, supplementing, and repealing a number of regulations on investment and business conditions under the state management of the Ministry of Science and Technology and a number of regulations on specialized inspection;
Pursuant to the Government's Decree No. 14/2017/NĐ-CP dated February 17, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Labour, War Invalids and Social Affairs;
At the request of the Director General of the Department of Occupational Safety;
The Minister of Labour, War Invalids and Social Affairs promulgates the Circular providing the List of products and goods with potential safety risks under the state management responsibility of the Ministry of Labour, War Invalids and Social Affairs.
Article 1. Scope of regulation
This Circular provides the List of products and goods with potential safety risks under the state management responsibility of the Ministry of Labour, War Invalids and Social Affairs (hereinafter collectively referred to as group-2 products and goods), together with their HS codes, and the state quality inspection measures applicable to imported group-2 products and goods.
Article 2. Subjects of application
This Circular applies to:
1. Domestic and foreign organizations and individuals operating in the territory of Vietnam that manufacture, import, trade in, or use group-2 products and goods under the state management responsibility of the Ministry of Labour, War Invalids and Social Affairs.
2. Organizations and individuals involved in the management, assessment, and certification of the quality of group-2 products and goods under the state management responsibility of the Ministry of Labour, War Invalids and Social Affairs.
Article 3. List of group-2 products and goods under the state management responsibility of the Ministry of Labour, War Invalids and Social Affairs
Promulgated together with this Circular is the List of group-2 products and goods under the state management responsibility of the Ministry of Labour, War Invalids and Social Affairs, together with the HS codes of such products and goods.
Article 4. State quality inspection measures for imported group-2 goods
1. Products and goods that must undergo state quality inspection upon import are specified in Section I of the List of group-2 products and goods under the state management responsibility of the Ministry of Labour, War Invalids and Social Affairs promulgated together with this Circular. State quality inspection of imported goods shall be carried out in accordance with Clause 2b, Article 7 of the Government's Decree No. 132/2008/NĐ-CP dated December 31, 2008, detailing a number of articles of the Law on Product and Goods Quality, as supplemented under Clause 3, Article 1 of Decree No. 74/2018/NĐ-CP amending and supplementing a number of articles of the Government's Decree No. 132/2008/NĐ-CP dated December 31, 2008, detailing the implementation of a number of articles of the Law on Product and Goods Quality.
2. Products and goods that are not required to undergo state quality inspection upon import are specified in Section II of the List of group-2 products and goods under the state management responsibility of the Ministry of Labour, War Invalids and Social Affairs promulgated together with this Circular.
Article 5. Effect
1. This Circular takes effect on July 18, 2021.
2. Circular No. 22/2018/TT-BLĐTBXH dated December 6, 2018 of the Minister of Labour, War Invalids and Social Affairs providing the List of products and goods with potential safety risks under the state management responsibility of the Ministry of Labour, War Invalids and Social Affairs ceases to be effective from the effective date of this Circular.
3. Where the national technical regulations on occupational safety applicable to products and goods under Section II of the List of group-2 products and goods under the state management responsibility of the Ministry of Labour, War Invalids and Social Affairs promulgated together with this Circular require quality inspection upon import, such inspection shall be carried out in accordance with Clause 2, Article 4 of this Circular.
Article 6. Implementation organization
1. Where the legal documents and standards cited in this Circular are amended, supplemented, or replaced, the new documents shall prevail.
2. In the course of implementation, if any difficulties or problems arise, agencies, organizations, and individuals shall report them to the Ministry of Labour, War Invalids and Social Affairs for study and resolution./.
