CIRCULAR

PROMULGATING THE HS CODE TABLE FOR THE LIST OF GOODS UNDER THE STATE MANAGEMENT AUTHORITY OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT AND THE LIST OF EXPORTED AND IMPORTED GOODS SUBJECT TO SPECIALIZED INSPECTION IN THE FIELD OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Government Decree No. 105/2022/ND-CP dated December 22, 2022, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Government Decree No. 69/2018/ND-CP dated May 15, 2018, detailing a number of articles of the Law on Foreign Trade Management;

Pursuant to Government Decree No. 85/2019/ND-CP dated November 14, 2019, providing for the implementation of administrative procedures under the national single window mechanism, the ASEAN single window mechanism, and specialized inspection of exported and imported goods;

At the proposal of the Director of the Department of Legal Affairs and the Directors of the Directorate/Departments of: Forestry; Fisheries; Plant Protection; Animal Health; Livestock Production; Crop Production; Cooperative Economy and Rural Development; Quality, Processing and Market Development;

The Minister of Agriculture and Rural Development promulgates the Circular promulgating the HS code table for the list of goods under the state management authority of the Ministry of Agriculture and Rural Development and the list of exported and imported goods subject to specialized inspection in the field of agriculture and rural development.

Article 1. Promulgated together with this Circular is the HS code table for the list of goods under the state management authority of the Ministry of Agriculture and Rural Development and the list of exported and imported goods subject to specialized inspection in the field of agriculture and rural development

1. Appendix I. HS code table for the list of goods under the state management authority of the Ministry of Agriculture and Rural Development, specifically:

Section 1. HS code table for the list of terrestrial animals and animal products subject to quarantine.

Section 2. HS code table for the list of other livestock animals.

Section 3. HS code table for the list of livestock breeds banned from export.

Section 4. HS code table for the list of livestock breeds requiring conservation.

Section 5. HS code table for the list of aquatic animals and aquatic animal products subject to quarantine.

Section 6. HS code table for the list of aquatic species permitted to be traded in Vietnam.

Section 7. HS code table for the list of aquatic species subject to conditional export.

Section 8. HS code table for the list of aquatic species banned from export.

Section 9. HS code table for the list of objects subject to plant quarantine of Vietnam.

Section 10. HS code table for the list of imported foods of plant origin.

Section 11. HS code table for the list of plant varieties.

Section 12. HS code table for the list of plant genetic resources banned from export.

Section 13. HS code table for the list of salt (including edible salt and denatured salt).

Section 14. HS code table for commercial animal feed products published on the Portal of the Ministry of Agriculture and Rural Development.

Section 15. HS code table for the list of chemicals, biological products, and microorganisms banned from use in animal feed.

Section 16. HS code table for the list of chemicals, biological products, microorganisms, and feed production materials permitted for use in aquaculture in Vietnam, and finished aquatic feed and aquaculture environment treatment products.

Section 17. HS code table for the list of chemicals, biological products, and microorganisms banned from use in aquatic feed and aquaculture environment treatment products.

Section 18. HS code table for the list of veterinary medicines and veterinary medicine materials permitted for import and circulation in Vietnam.

Section 19. HS code table for the list of fertilizers.

Section 20. HS code table for the list of goods banned from export, being round timber and sawn timber of all kinds from domestic natural forests.

Section 21. HS code table for the list of timber and timber-processed products required to have legal forest product dossiers when exported.

Section 22. HS code table for the list of forestry plant varieties.

Section 23. HS code table for the list of plant protection products.

Section 24. HS code table for the list of plant protection products banned from use in Vietnam.

Section 25. HS code table for the list in the field of aquatic exploitation.

Section 26. HS code table for the list of livestock waste treatment products.

Section 27. HS code table for the list of agricultural machinery and equipment.

2. Appendix II. HS code table for the list of imported goods subject to specialized inspection before customs clearance under the state management authority of the Ministry of Agriculture and Rural Development.

3. Appendix III. HS code table for the list of imported goods subject to specialized inspection after customs clearance under the state management authority of the Ministry of Agriculture and Rural Development.

Article 2. Regulations on the use of the lists

1. The list of goods under the state management authority of the Ministry of Agriculture and Rural Development, with commodity codes identified and promulgated together with this Circular, serves as the basis for organizations and individuals to make customs declarations when exporting to or importing goods into Vietnam.

2. When exporting or importing goods in the agricultural sector that do not yet have a commodity code in the list promulgated together with this Circular, the customs declaration shall be made according to the actual description of the goods and the List of Exported and Imported Goods of Vietnam promulgated together with Circular No. 31/2022/TT-BTC dated June 8, 2022, of the Minister of Finance. After customs clearance, organizations and individuals shall send a written document to the Ministry of Agriculture and Rural Development to coordinate with the Ministry of Finance in reviewing, reaching agreement, updating, and promulgating a supplementary list.

3. Specialized inspection of exported goods under the state management authority of the Ministry of Agriculture and Rural Development shall be conducted at the request of the enterprise, to serve customs clearance of the goods in the importing country.

Article 3. Effect

1. This Circular takes effect from March 20, 2024

2. This Circular replaces and repeals the following Circulars and regulations:

a) Replaces Circular No. 11/2021/TT-BNNPTNT dated September 20, 2021, of the Minister of Agriculture and Rural Development promulgating the HS code table for the list of goods under the state management authority of the Ministry of Agriculture and Rural Development and the list of exported and imported goods subject to specialized inspection in the field of agriculture and rural development;

b) Replaces Section 3.1, Section 4, Section 8, and Section 9 of the Appendix promulgated together with Circular No. 16/2021/TT-BNNPTNT dated December 20, 2021, of the Minister of Agriculture and Rural Development promulgating the list of products and goods capable of causing unsafety under the management responsibility of the Ministry of Agriculture and Rural Development, with the corresponding sections in Appendix IV promulgated together with this Circular;

c) Repeals Article 9 of Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022, of the Minister of Agriculture and Rural Development amending and supplementing a number of Circulars in the field of fisheries;

d) Repeals Appendix XXIII promulgated together with Circular No. 01/2022/TT-BNNPTNT dated January 18, 2022, of the Minister of Agriculture and Rural Development amending and supplementing a number of Circulars in the field of fisheries.

Article 4. Implementation responsibility

1. The Chief of the Ministry Office, the Director of the Department of Legal Affairs, the heads of units under the Ministry of Agriculture and Rural Development, and relevant agencies, organizations, and individuals are responsible for implementing this Circular.

2. In the course of implementation of this Circular, if difficulties arise, please promptly report them to the Ministry of Agriculture and Rural Development for study, amendment, and supplementation as appropriate.
