DECISION

ON THE PROMULGATION OF GROUP-2 PRODUCTS AND GOODS UNDER THE MANAGEMENT RESPONSIBILITY OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Product and Goods Quality dated November 21, 2007;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of a number of articles of the Law on Standards and Technical Regulations; Decree No. 78/2018/NĐ-CP dated May 16, 2018 of the Government amending and supplementing a number of articles of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of a number of articles of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of a number of articles of the Law on Product and Goods Quality; Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government amending and supplementing a number of articles of Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of a number of articles of the Law on Product and Goods Quality; Decree No. 154/2018/NĐ-CP dated November 9, 2018 of the Government amending, supplementing, and abolishing a number of provisions on investment and business conditions in the fields under the state management of the Ministry of Science and Technology and a number of provisions on specialized inspection; and Decree No. 13/2022/NĐ-CP dated January 21, 2022 amending and supplementing a number of articles of Decree No. 132/2008/NĐ-CP dated December 31, 2008, Decree No. 74/2018/NĐ-CP dated May 15, 2018 of the Government detailing a number of articles of the Law on Product and Goods Quality, and Decree No. 86/2012/NĐ-CP dated October 19, 2012 of the Government detailing and guiding the implementation of a number of articles of the Law on Measurement;

Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017 of the Government defining the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director General of the Directorate for Standards, Metrology and Quality and the Director of the Department of Legal Affairs,

DECIDES:

Article 1. To promulgate the group-2 products and goods under the management responsibility of the Ministry of Science and Technology set out in the Appendix issued together with this Decision, including HS codes, the corresponding national technical regulations (QCVN), and the governing legal instruments.

1. For domestically manufactured group-2 products and goods, management measures shall be as prescribed in the corresponding national technical regulations.

2. For imported group-2 products and goods, management measures shall be applied as prescribed in:

a) Circular No. 06/2020/TT-BKHCN dated December 10, 2020 of the Minister of Science and Technology detailing and prescribing measures for implementing a number of articles of Decree No. 132/2008/NĐ-CP dated December 31, 2008, Decree No. 74/2018/NĐ-CP dated May 15, 2018, Decree No. 154/2018/NĐ-CP dated November 9, 2018, and Decree No. 119/2017/NĐ-CP dated November 1, 2017 of the Government;

b) National technical regulation QCVN 20:2019/BKHCN and Amendment 1:2021 to QCVN 20:2019/BKHCN.

Article 2. The Directorate for Standards, Metrology and Quality shall take the lead and coordinate with relevant agencies and units to conduct an annual review and propose to the leadership of the Ministry of Science and Technology amendments and supplements to the group-2 products and goods under the management responsibility of the Ministry of Science and Technology in line with management requirements (if any).

Article 3. This Decision takes effect from the date of its signing and promulgation.

1. For gasoline, diesel fuel, and biofuel products, the provisions of National Technical Regulation QCVN 1:2015/BKHCN and Amendment 1:2017 to QCVN 1:2015/BKHCN shall apply until National Technical Regulation QCVN 01:2022/BKHCN takes effect as prescribed in Circular No. 16/2022/TT-BKHCN dated December 15, 2022 of the Ministry of Science and Technology.

2. This Decision replaces the following Decisions:

a) Decision No. 3810/QĐ-BKHCN dated December 18, 2019 of the Minister of Science and Technology on the promulgation of group-2 products and goods under the management responsibility of the Ministry of Science and Technology;

b) Decision No. 3115/QĐ-BKHCN dated November 13, 2020 of the Minister of Science and Technology amending and supplementing Decision No. 3810/QĐ-BKHCN dated December 18, 2019 of the Minister of Science and Technology on the promulgation of group-2 products and goods under the management responsibility of the Ministry of Science and Technology.

3. During implementation, organizations and individuals shall promptly report in writing any difficulties or obstacles to the Ministry of Science and Technology (through the Directorate for Standards, Metrology and Quality) for guidance or consideration of appropriate amendments and supplements.

Article 4. The Director General of the Directorate for Standards, Metrology and Quality, the Director of the Department of Legal Affairs, and relevant organizations and individuals are responsible for the implementation of this Decision./.
