1. The List of goods prohibited from being traded by temporary import for re-export or by transfer between countries is prescribed in Appendix V issued with this Decree.
2. The List of goods in Clause 1 of this Article does not apply to goods traded by transfer between countries in the form of goods transported directly from the exporting country to the importing country without passing through a Vietnamese border gate.
3. To prevent environmental pollution, epidemics, harm to human health and life, illegal transshipment and risks of trade fraud, the Minister of Industry and Trade shall decide on the specific goods subject to temporary suspension of business by temporary import for re-export or by transfer between countries and shall publicly announce the List together with the HS codes of the goods.
Article 14. Business by temporary import for re-export
1. The provincial People's Committee is the agency competent to issue the Licence for business by temporary import for re-export for goods specified at Point a, Clause 1, Article 39 of the Law on Foreign Trade Management, except in the cases specified in Clauses 2 and 3 of this Article. The dossier and licensing procedure comply with Articles 20 and 21 of this Decree.
2. Foreign-invested economic organisations may only carry out temporary import for re-export of goods under Article 16 of this Decree and may not carry out business activities of temporary import for re-export of goods.
3. Where current law already provides that goods require a licence upon temporary import for re-export, the trader complies with that provision and does not need a Licence for business by temporary import for re-export under this Decree.
4. Goods traded by temporary import for re-export are subject to inspection and supervision by the customs authority from temporary import until the goods are actually re-exported from Vietnam. Containerised goods must not be broken up throughout transport from the temporary import border gate to the area under customs supervision or the re-export border gate as prescribed.
Where transport requirements necessitate changing or breaking up containerised goods for re-export, this is carried out according to the regulations of the customs authority.
5. Goods traded by temporary import for re-export may stay in Vietnam for no more than 60 days from the date of completing customs procedures for temporary import. Where an extension is needed, the trader sends a written extension request to the customs authority where the temporary import procedures were carried out; each extension shall not exceed 30 days and there shall be no more than 02 extensions for each consignment temporarily imported for re-export. After the above period, the trader must re-export the goods from Vietnam or destroy them.
Where goods traded by temporary import for re-export are destroyed because the period of stay in Vietnam has been exceeded, the trader organises the destruction itself and is responsible for carrying it out under the law on environmental protection and the law on customs.
Where the goods are imported into Vietnam, the trader must comply with regulations on import management and tax.
6. Business by temporary import for re-export is carried out on the basis of two separate contracts: an export contract and an import contract. The export contract may be signed before or after the import contract.

Traders may temporarily import from abroad for re-export goods not subject to management by the measures of prohibition of export or import or temporary suspension of export or import, for warranty, maintenance, lease, loan or other purposes for a certain period and then re-export those same goods from Vietnam. Traders carry out temporary import and re-export procedures at the customs authority, except in the cases specified in Clauses 2 and 9 of this Article.
2. The provincial People's Committee is the agency competent to issue the Licence for temporary import for re-export in other forms for goods not yet permitted to circulate or be used in Vietnam as specified at Point a, Clause 2, Article 41 of the Law on Foreign Trade Management, on the basis of written consent of the Ministry or ministerial-level agency competent to manage those goods, except in the cases specified in Clauses 3, 4 and 9 of this Article. The dossier and licensing procedure comply with Articles 20 and 21 of this Decree.
3. For goods produced by the trader and already exported, the trader may temporarily import them for warranty, maintenance, repair or replacement at the request of a foreign trader and re-export them back to the foreign trader. Temporary import and re-export procedures are carried out at the customs authority, without needing a Licence for temporary import for re-export.
Where goods temporarily imported under this Clause are subject to management by the measures of prohibition of import or temporary suspension of import, when carrying out temporary import and re-export procedures, in addition to the prescribed customs dossier, the trader must additionally submit the following papers:
a) Documents proving that the trader produced and exported those goods, and the export declaration for which customs procedures have been completed.
b) A written undertaking of the trader that the goods are temporarily imported only for warranty, maintenance, repair or replacement at the request of the foreign trader and then re-exported back to the foreign trader, and are not put into use or consumed on the Vietnamese market.
4. For temporary import for re-export of machinery, means, equipment and tools serving diplomatic events, cultural programmes, art troupes, competition teams, sports performances and humanitarian medical examination and treatment programmes, temporary import and re-export procedures are carried out at the customs authority, without needing a Licence for temporary import for re-export.
Where machinery, means, equipment and tools temporarily imported under this Clause are subject to management by the measures of prohibition of import or temporary suspension of import, when carrying out temporary import and re-export procedures, in addition to the prescribed customs dossier, the trader must additionally submit the following papers:
a) A document of a competent agency or organisation permitting the reception of a medical examination and treatment delegation or the organisation of the event.
b) A document of the trader undertaking to use the items for the proper purpose and under the law of the agency or organisation permitted to receive the medical examination and treatment delegation or organise the event.
5. Where current law already provides that goods require a licence upon temporary import for re-export, the trader complies with that provision and does not need a Licence for temporary import for re-export under this Decree.
6. Other forms of temporary import for re-export specified in this Article must ensure that the shape, use and basic characteristics of the goods are not changed and no other goods are created.
7. The period of temporary import for re-export of goods complies with Clause 3, Article 41 of the Law on Foreign Trade Management. Where an extension is needed, the trader sends a written extension request to the customs authority where the temporary import procedures were carried out. Each consignment temporarily imported for re-export may be extended no more than 02 times.
8. Where goods temporarily imported under a lease or loan contract are designated by the foreign partner for delivery to a trader for temporary import and re-export under a lease or loan contract signed with that foreign partner, the trader must comply with the regulations on temporary import for re-export in this Article. Customs procedures are carried out according to the guidance of the Ministry of Finance.
9. The Ministry of National Defence and the Ministry of Public Security consider and permit temporary import for re-export of goods serving national defence and security purposes. The dossier and licensing procedure comply with the regulations of the Ministry of National Defence and the Ministry of Public Security.
Article 17. Temporary export for re-import
1. Traders may temporarily export goods abroad for re-import for purposes of production, construction, lease, loan, measurement and testing, examination, participation in fairs and exhibitions, repair, warranty, maintenance or other purposes for a certain period and then re-import those same goods into Vietnam.
