CIRCULAR
SUPPLEMENTING THE DETAILED LIST OF EXPORTED AND IMPORTED GOODS BY HS CODE PROVIDED FOR IN CERTAIN CIRCULARS OF THE MINISTRY OF INDUSTRY AND TRADE
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to Decree No. 98/2017/ND-CP dated August 18, 2017 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 69/2018/ND-CP dated May 15, 2018 of the Government detailing a number of articles of the Law on Foreign Trade Management;
Implementing Decision No. 1254/QD-TTg dated September 26, 2018 of the Prime Minister approving the Action Plan to promote the National Single Window, the ASEAN Single Window, reform specialized inspection of exported and imported goods, and facilitate trade for the 2018-2020 period;
At the proposal of the Director General of the Import-Export Department,
The Minister of Industry and Trade promulgates the Circular supplementing the detailed list of exported and imported goods by HS code provided for in certain Circulars of the Ministry of Industry and Trade, as follows:
Article 1. Circular No. 30/2018/TT-BCT dated October 1, 2018 of the Minister of Industry and Trade detailing a number of articles of Decree No. 107/2018/ND-CP dated August 15, 2018 of the Government on rice export trading (Circular No. 30/2018/TT-BCT)
Promulgated together with this Circular is Appendix I - Detailed list by HS code for exported paddy and rice provided for in Circular No. 30/2018/TT-BCT.
Article 2. Circular No. 10/2011/TT-BCT dated March 30, 2011 of the Minister of Industry and Trade amending, supplementing and repealing a number of provisions on administrative procedures in the field of export and import under Resolution No. 59/NQ-CP dated December 17, 2010 of the Government on simplifying administrative procedures within the functional management scope of the Ministry of Industry and Trade (Circular No. 10/2011/TT-BCT)
Promulgated together with this Circular is Appendix II - Detailed list by HS code for sassafras essential oil temporarily imported for re-export provided for in Circular No. 10/2011/TT-BCT.

Promulgated together with this Circular is Appendix IV - Detailed list by HS code for gasoline and oil provided for in Circular No. 38/2014/TT-BCT.
Article 5. Circular No. 12/2016/TT-BCT dated July 5, 2016 of the Minister of Industry and Trade amending and supplementing a number of articles of Circular No. 41/2012/TT-BCT dated December 21, 2012 of the Minister of Industry and Trade regulating mineral exports (Circular No. 12/2016/TT-BCT)
Supplement the detailed HS codes for exported minerals provided for in Appendix 1 of Circular No. 12/2016/TT-BCT as set out in Appendix V - Detailed list by HS code for exported minerals promulgated together with this Circular. Other matters concerning quality standards and export duration shall comply with the provisions of Appendix 1 of Circular No. 12/2016/TT-BCT and relevant laws.
Article 6. Circular No. 57/2018/TT-BCT dated December 26, 2018 of the Minister of Industry and Trade detailing a number of articles of the Decrees related to tobacco business (Circular No. 57/2018/TT-BCT)
1. Promulgated together with this Circular is Appendix VI - Detailed list by HS code for tobacco raw materials and cigarette paper provided for in Circular No. 57/2018/TT-BCT.
2. Supplement the detailed HS codes for specialized tobacco machinery and equipment provided for in Appendix 72 of Circular No. 57/2018/TT-BCT as set out in Appendix VII - Detailed list by HS code for specialized tobacco machinery and equipment promulgated together with this Circular.
Article 7. Circular No. 15/2013/TT-BCT dated July 15, 2013 of the Minister of Industry and Trade regulating coal exports (Circular No. 15/2013/TT-BCT)
Supplement the detailed HS codes for exported coal provided for in Appendix 1 of Circular No. 15/2013/TT-BCT as set out in Appendix VIII - Detailed list by HS code for exported coal promulgated together with this Circular. Other matters concerning particle size, dry ash content, calorific value, quality standards and export duration shall comply with the provisions of Appendix I of Circular No. 15/2013/TT-BCT and relevant laws.
Article 8. Principles for applying the list
1. Where only a 4-digit HS code is listed, all 8-digit HS codes under that 4-digit HS heading shall apply.
2. Where only a 6-digit HS code is listed, all 8-digit HS codes under that 6-digit HS subheading shall apply.
3. Where the list specifies detail down to an 8-digit HS code, only that 8-digit HS code shall apply.
Article 9. Effect
1. This Circular takes effect from January 29, 2020.
2. In the course of implementing this Circular, if any difficulties arise, traders, agencies, organizations and individuals concerned shall report them to the Ministry of Industry and Trade for settlement.
