DECISION

ON PROMULGATION OF THE LIST OF GOODS SUBJECT TO ENERGY EFFICIENCY TESTING AND ENERGY LABELING UNDER THE MANAGEMENT RESPONSIBILITY OF THE MINISTRY OF INDUSTRY AND TRADE

MINISTER OF INDUSTRY AND TRADE

Pursuant to the Law on Product and Goods Quality dated November 21, 2007;

Pursuant to the Law on Economical and Efficient Use of Energy dated June 17, 2010;

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to the Government's Decree No. 21/2011/NĐ-CP dated March 29, 2011 detailing and providing measures for the implementation of the Law on Economical and Efficient Use of Energy;

Pursuant to the Government's Decree No. 96/2022/NĐ-CP dated November 29, 2022 defining the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government's Decree No. 132/2008/NĐ-CP dated December 31, 2008 detailing a number of articles of the Law on Product and Goods Quality, as amended and supplemented by the Government's Decree No. 74/2018/NĐ-CP dated May 15, 2018 and Decree No. 154/2018/NĐ-CP dated November 9, 2018;

Pursuant to Decree No. 85/2019/NĐ-CP dated November 14, 2019 providing for the implementation of administrative procedures under the National Single Window mechanism, the ASEAN Single Window mechanism, and specialized inspection of exported and imported goods;

Pursuant to the Prime Minister's Decision No. 04/2017/QĐ-TTg dated March 9, 2017 prescribing the List of means and equipment required to bear energy labels, the application of minimum energy efficiency levels, and the implementation roadmap;

Pursuant to the Prime Minister's Decision No. 14/2023/QĐ-TTg dated May 24, 2023 promulgating the List and roadmap for energy-using means and equipment to be phased out and inefficient power generation units not to be newly built;

Pursuant to Circular No. 36/2016/TT-BCT dated December 28, 2016 prescribing energy labeling for energy-using means and equipment under the management of the Ministry of Industry and Trade;

Pursuant to the Ministry of Finance's Circular No. 31/2022/TT-BTC dated June 8, 2022 on Vietnam's List of Exported and Imported Goods;

Pursuant to Decision No. 1182/QĐ-BCT dated May 20, 2019 of the Minister of Industry and Trade on the promulgation of the List of goods (with accompanying HS codes) subject to specialized inspection under the management responsibility of the Ministry of Industry and Trade;

At the proposal of the Director of the Department of Energy Conservation and Sustainable Development.

DECIDES:

Article 1. To promulgate the List of goods (with accompanying HS codes) subject to energy efficiency testing and energy labeling under the management responsibility of the Ministry of Industry and Trade in the Appendices attached to this Decision.

Article 2. Organization of implementation:

To assign the Department of Energy Conservation and Sustainable Development to (i) take the lead and coordinate with relevant agencies and units in reviewing, updating, and announcing the list of goods (with accompanying HS codes) subject to energy efficiency testing and energy labeling under the management responsibility of the Ministry of Industry and Trade in accordance with state management requirements in each period; (ii) promptly provide guidance on and resolve any difficulties or issues arising (if any) in specialized inspection activities relating to the list in the Appendix to this Decision.

Article 3. Implementation provisions:

1. This Decision takes effect from the date of signing.

2. This Decision replaces Appendix III of Decision No. 1182/QĐ-BCT dated May 20, 2019 of the Minister of Industry and Trade on the promulgation of the List of goods (with accompanying HS codes) subject to specialized inspection under the management responsibility of the Ministry of Industry and Trade.

3. In case the legal documents referenced in this Decision are amended or supplemented, the provisions of the corresponding amending document shall apply.

Article 4. The Chief of the Ministry Office, the Directors of the Department of Science and Technology and the Department of Energy Conservation and Sustainable Development, the heads of units under the Ministry of Industry and Trade, and relevant organizations and individuals shall be responsible for implementing this Decision.
